    • Yep, I read that and thought about trying to find out what the consideration and grace period is at Riverside but not sure I can. I know they say "You must tell us the specific consideration/grace period at a site if our compliance team or our agents ask what it is"  but I doubt they would disclose it to the public, maybe I should have asked in my CPR 31.14 letter? Yes, I think I can get rid of 5 minutes. I am also going to include a point about BPA CoP: 13.2 The reference to a consideration period in 13.1 shall not apply where a parking event takes place. I think that is Deception .... They giveth with one hand and taketh away with the other!

    • the Town and Country [advertisments ] Regulations 2007 are not easy to understand. Most Council planing officials don't so it's good that you found one who knows. Although he may not have been right if the rogues have not been "controlling" in the car park for that long. The time only starts when the ANPR signs go up, not how long the area has been used as a car park.   Sadly I have checked Highview out and they have been there since at least 2014 . I have looked at the BPA Code of Practice version 8 which covers 2023 and that states Re Consideration and Grace Periods 13.3 Where a parking location is one where a limited period of parking is permitted, or where drivers contract to park for a defined period and pay for that service in advance (Pay & Display), this would be considered as a parking event and a Grace Period of at least 10 minutes must be added to the end of a parking event before you issue a PCN. It then goes on to explain a bit more further down 13.5 You must tell us the specific consideration/grace period at a site if our compliance team or our agents ask what it is. 13.6 Neither a consideration period or a grace period are periods of free parking and there is no requirement for you to offer an additional allowance on top of a consideration or grace period. _________________________________________________________________________________________________________________So you have  now only overstayed 5 minutes maximum since BPA quote a minimum of 10 minutes. And it may be that the Riverside does have a longer period perhaps because of the size of the car park? So it becomes even more incumbent on you to remember where the extra 5 minutes could be.  Were you travelling as a family with children or a disabled person where getting them in and out of the car would take longer. Was there difficulty finding a space, or having to queue to get out of the car park . Or anything else that could account for another 5 minutes  without having to claim the difference between the ANPR times and the actual times.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

took my car to a garage today as heater not working said they would ring me when they found out what was wrong with it gave them my mobile number, they rang me over 3 hrs later to say the car was fixed and was ready to pick up at the cost of i thought they were going to ring me with a price £65.00 well i havent got the money today to pay for it so cant get my car back, i thought they were going to ring me with a price and date for repair that was my understanding, so im not a happy bunny, guy was really sharp with me when i asked what they were going to do about my wheel locking nut which they lost when was in for previous job, first they admitted loosing it now they dont feel like such an idiot

ahhhh too late to say once bitten Liberty .....they seem to be a bunch of shysters there sorry to read they have done this to you....I have a really great mechanic mate here he's a wizzard at his job and mate's rates are always applied to my work he does for me.....some on here dont think mates rates are real but they probably have not as many mates as me

Hi D/T yes I have yet another check up by the orthopedic consultant and he's now telling me that the problems with my right shoulder are now rhumatic...."bullcrap" there was nothing at all wrong with my right shoulder before the trip over the path and certainly NO problems with my neck and now there's a conflick between his diagnosis and the diagnosis with the chiorpractor or whatever he's called....he knows I have whiplash so now thats all in the hands of a solicitor and the solicitor has now told me that she wants me to pester my GP's about the biopsy to the lumps in my neck- left shoulder and spine and she told me that if they keep palming me away then she will make an appointment with their own GP's who they take cases to....It still riles me about the disclaimer that my GP surgery manager mailed to me and asked me to sign....der ok ofcourse i will.......you couldnt make this up

 

 

Did you explain to the chiropractor about the lumps?

 

Glad the Solicitor is involved.

I did explain the the Chiro about the one in my next due to he spotted it first and also I told him of the breastbone lump so that was the reason i could not lay face down on his couch thingy "he must have thought he had a right one here" lol the lump thats formed over my shoulder and at the nape of my neck were not there last feb when I was bein seen by the chiro these haave formed since about march april time this year and now my neck almost feels like someone is gently trying to strangle me almost 24-7 horrible sensations I can also feel the lumps are migrating in part to the right of my spine and down my left shoulder.....I know you must have mental images of a quasi modo now but it's not that big a lump but big enough....my worry is that the nape of neck lump is starting to make my head bow and thats just what happened to my elder sister about 18 months before she died of throat cancer in 2003....that is my worse fear although the blood tests i have regularly for my diabetis do not show anything unless that are lying to me as it seems some are :-x....I hope my fears are not fullfilled for my boys sakes more than mine

Had two of them mate and ultra sound on the lump in my breastbone and abdomen.....there are issues with my abdomen BUT they keep sending letters to me saying ...no need for concern.....they can tell that to the solicitor when I get the money together to go private....It's my belief that I was diagnosed wronly four years ago and now there are so many signatures from various departments they have to keep the fib going....I do not believe a word any of them say now and especially since I was sent a disclaimer from my GP's surgery a few months ago to say that IF anything came to light at a later date then the disclaimer would waive their responsibility....and no I didnt sign it I kept it for potentual evidence.....you couldnt make this up and no I'm in some kind of munchousen syndrome this IS real and happening to me....I spoke to someone on the phone last night and she could not believe my build and stature to my voice and they way I sound its almost a whisper I have to talk in now due to my throat she was expecting to hear a deep gruff voice she told me she just about heard what I was saying

thats awful burly, why are they all ignoring you, why dont you ask for your medical file off the hospital and look through it you might find out something then would be worth it surely, you will probably get the mri, xrays, bloods, everything then take them to a consultant and tell them you want something done now not next month

nothing made me want to swear. i did swear. i guess i can't post the words i used... but it was after being on the phone for over 3 hours yesterday, whilst nearly an hour today - only for my phone call to be transferred (by BT) transferred to another department to then be given a message saying this number is not recognised....

this was after i had already discussed this problem with BT saying that my calls were passed around to different people yesterday without success.

 

all because they attached a cable to my home without my permission....

 

anyway, i did not feel better after my 2 swear words!

Some drivers are idiots. Got picked up earlier and was told before I was being picked up, that my sister (who is a learner) would be driving. On the way to hers, she stalls the car and tries a few times to get it started. During this time, she was at the bottom of a hill and someone has decided that it was a good idea to get passed her.

..Its easier said than done :-( I need to have a biopsy on the lumps that have appeared and started to solidfy in my neck and shoulder and they keep ignoring my requests and thats where the solicitor came in due to while she has started a claim about my damaged righ arm and shoulder she was disgusted when i tried to explain to her on the phone as to what my GP's has done....I have recorded evidence too from one of their locums who when I asked FOUR times as to what the lump was on the nape of my neck he denied I'd asked four times about it ....he's on my dictaphone as is the FOUR requests for him to look at the lump.....I had to shout back at him when he shouted to me about it......they want my respect ....it has to be earnt. I know this is open to all for viewing and there is not one lie or anything from me in here it makes me f--k sick to have to be in this position.....I'm still pushing for the biopsy they are NOT going to fobb me off with their bullcrap but they dont know whats around the next corner for them the snide gits....this could be my life on the line all thanx to their sh-tty excuse of diagnosis

I complained to PALS and they said they would investigate my claims about why and where and or how I could proceed with the biopsy request....three times I called them in total only to be told that no investigation was recorded.....theres a rotten smell in NHS in this area....the complaints were laid almost two months ago and the GMC wrote back to ask where my evidence was on dates and times and reasons for visiting my GP due to they could see no case to look at in my complaint....isnt that what doctors notes are supposed to show.....I have kept every single letter from whoever I have had replies from I honestly think I am being seen as possibly a headcase and one gp even asked me if I would see a head specialist....I told him to do one and to shove his prescription for antidepressants due to I'm not having him add tranquilizers to my list of pills I have to take for my heart etc.....it's a cronic state of affairs thats surrounding me here

 

ps I also gave the two boxes of sleeping tablets back to the same GP

I only do recorded delivery now D/T ....way to many devious people now working against us

 

Recorded is signed for so you can check it has arrived but not tracked if it doesn't get there. Special costs a bit more but is tracked. In this case i'm sure recorded is sufficient.

PALS. Do find it a bit convenient that they managed to miss out something really important (the refusal to diagnose me; as I have requested, hence referral) regarding my complaint. And they seem to be siding with the psychiatrist. They claim he's done his job properly (he bloody well hasn't - unless lying to a patient for months is considered doing your job properly?) and that some of the blame lies with my GP surgery.

We should compare notes Nyst.....it makes me sick and also worried about my case's due to the amount of dodging issues that these so called consultants and iffy GP's I bet none of them can lie strait in bed.....it was run past me about a year ago to perhaps see a shrink:!: I told that GP to basicly walk away in jerky movements ....I see it like this...if I were to see a shrink then they could say in court....look me lud hes mental ....we rest our case me-lud

Why should they think you need to see a shrink when the physical is apparent?
