      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Trying to get car insurance for my 18 year old son - car worth £1000, insurance quotes from £5,500 - £9,000k - not all 18yr olds are boy racers! at Christmas the same quote was £1000 but OH wanted to wait to get him a car!!!!!!!!!!!!!!!!!!!!!!!!!!!!! We could actually buy a brand new Vauxhall Corsa 1.4 lxi - the insurance amount is given back as a cash back, monthly finance £275 for 60 months - the cheapest option but then in a years time - the insurance is still going to be thousands, if you sell the car like the adviser said and re purchase and get the insurance cash back again - how much depreciation will there be!!!!!!!!!!!!!!!!

A TEENAGER who was quoted almost £18,000 to insure his P-reg VW Polo is now using a tractor to get around.

The Bolton News yesterday revealed how Chris Berry, aged 18, was stunned to hear how insurance for the one litre car would cost him £17,800 for a year.

 

“Not many people can say they drive a Fordson Major!

“It’s a hell of a lot cheaper than a car—other than the insurance only being £57 a year, you never have to have an MOT, and when it’s 25 years old it’s tax exempt.

“And it can go 40mph — on a good day.”

Quinn Direct, an insurance company specialising in young motorists, has carried out research which shows the average cost of getting on the road for a first time driver is £8,260.

SAMSUNG made me lose it today!!!!!!

I've got a samsung 40" lcd series 6 0ut of warraty etc,had it since july 2008 got it from comet.xmas just gone it started popping & cracking emailed/contacted comet etc went for the 'SALES OF GOODS ACT' route and got put on to samsung to get the capactors replaced for free due to manufacturing issue's.ICTV repair engineer came to my house & replaced the capactors,while the tv was in bit's it was found that the main top metal support bracket inside the tv which my wall mount bracket bolts to was found to have corrosion in the middle where a black felt type pad is mounted for tv back panel,ICTV said that best for me to chase up samsung about it,I made a fue phone calls to different samsung repair agents and spoke to one engineer who said that he had come across this same problem & that it was down to tv's been stored after production in SLOVAKIA back in may 2008 been stored in a slightly damp conditions,I've chased up samsung about this with no luck!!!!!.

Month ago my tv started playing up again contacted samsung by email as I can't be doing with speaking to sumone in another country,they put me on to ICTV again they collected my tv this time took it without the box which I was not happy about as it was all packed ready for collection,two weeks later I hear from ICTV saying my tv is fixed & that they could not find the fault I reported & all they found was a noisey fan of which I allready knew about,they replaced the fan without my consent said that bill would be £150+ sumthink or cheaper if I collected the tv from them,I went off the head big time,sent samsung email,got reply to call samsung to which I spoke to sumone this morning,they said that no they would not help it's out of warranty & they would not do nothing about the rusted bracket inside the tv,,,,,,,,,,well I spoke my mind to the bloke on the phone and gave it to him large,hope they recorded it!.

Well i'm at a total loss now as I'm unable to work at the moment due to ill health/medical negligence otherwise I would just foot the bill & ebay the tv.

I was awoken at 5.30 this morning by my beautiful german shepherd having a seizure,this one of the worst he's had so far,as he came out i went to wipe his mouth (excess saliva) and he bit me,my left hand is now rendered useless.

 

What a start to the week........and yes i did swear,i have to have it stiched up.:sad:

He's back to normal now thank goodness,it's awful to witness.

Thanks for the hug,i just got back from A&E,i have to go to a london hospital today to see a plastic surgeon the tendons in my fingers are torn.

 

There's an upside i'm getting severly pampered as i'm all bandaged up and they put a sling on,so i'm taking advantage of the rest:lol:

i have had an internet stalker for about a year now, i know who she is , and when ever i post on the internet there she is answering my posts under different names shes a very sad woman with nothing in her life, sits at her comp every night gets drunk then starts her abuse she was also on here and still is!!!! under a different name but i know who she is, i ignore her sad really she has no life but i have and enjoy my life, stalkers have no life but their internet ignore and block them every way you can ny,

i agree Caro, the police told us if you ignore them change your phone numbers block them anyway you can this annoys them because then they have no way of getting to you, my one contunually trys to make friends with me on facebook hahah do they think we are soft in the head, shut them out, block them, ignore them, it works,:smile:
