    • Hello, Following the submission of my defense, last night I received an email from DCBL indicating that the claimant intends to proceed with the claim (I've attached a screenshot of the email for reference) along with the N180 directions questionnaire. I'm unsure how they obtained my email, but I suspect it was through the courts' form when I completed the Acknowledgment of Service. This email almost slipped my attention. I have also today received a letter from court to state they have received my defense.  It appears they are requesting an online telephone hearing with the court.     • Default Amount £9237.88, all this started in 2006 Admitted debt £9075.65 Weightmans added £1515.01 immediately they became involved, no explanation The Statement shows when Marlin bought debt in May 2011 £10439.25 Their statements, not received until the SAR, are based on this. Cabot deducted £1515.01on their statements in January 2019, again did not find this out until SAR. Weightmans added in  2007 after the CH1 etc was confirmed by the court £741.50, made up of Process server fees, Court Fee (they tried for bankruptcy), Solicitors fee and Land Registry fee. Unspecfied Legal costs were added by Marlin in March 2015, again I did not know this until statements received with SAR I had been paying monthly, without exception until December 2018. I am minded to take the property charge, CH1 amount ,deduct all my payments and the subsequent fees, and request/demand a refund on the final payment made? I consistently disputed Weightmans balances, but they never responded. I also told Mortimer Clarke/Cabot that I disputed their amounts.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

The Doctor was expecting his appointment to be the same day. Usually this is the case however the fracture clinic is much busier than normal due to the icy weather.

 

The Nurse did say if it got worse then to go back to A&E during the day time as there would be more Doctors availiable then. Yesterday I tried to persuade my son to go back and he refused as he did not want to cause a fuss and did not want to wait around for another 4 hours. He is taking pain killers and says he can wait till tomorrow to be seen.

This morning had headache, wanting to be sick dizzyness and just wanting to sleep. the only person effected.

Everytime l went into our bedroom all i wanted to do was be sick and get an instant headache.

 

Council have been out and pulled the boiler apart, this is in a cupboard in the bedroom that l was sleeping in and causing the problems. Noting wrong with boiler. Checked rads for probs. Noting wrong. Checked water again nothing. Every check the council done nothing came up. They even stood on a ladder looking round the room??

 

Now the headaches have stopped the sickness has stopped and every other symptom has stop as misterily as they arrived. Drs has said dont know whats up done tests as iam anemic as the dizzyness and sleep issue could be part of that. iam not pregnant as they done that test. No i was not drunk as i drunk no alcohol in weeks and basically the Council and Drs are scratching there head.

Spoke to a mum at the school who said could it to be with the feng shui of the room, threw gritted teeth l said dont think so as l would have had the problems when l moved in rather than just now.

 

Sensible suggestions please.

 

Do you have a carbon monoxide monitor/sensor???

According to the company who is employed by the landlord the system does not need them cause if we have a problem they will come out with there equipment.

 

Were also not allowed to install our own cause they will not be tested as most of the ones on the market are not any good and keep meaning the company is being called out for nothing.

Just an update:

My son went back to the hospital today and all is well. He only had a slight dislocation. Still in lots of pain but shoulder back in place.

The Doctor said that it did not make any difference if he had seen him straight from A&E or two days later. Infact seeing him today was better as some of the swelling had gone down. (So that's ok then:rolleyes:)

Have to admit my first thought opon reading GM's post were that it sounded like carbon monoxide. It's not something I'd take risks with. Our old fire years ago was giving off carbon monoxide. Had it stripped out but I remember at the time feeling sick etc and it was like having a cold that wouldn't shift.

 

I swore today when I went to open our back gate, when trying to open the stuck bolt with force I failed and my hand slipped and hit me right between the eyes. Hope nobody was peeping out of their curtains it would have looked very funny. Made my eyes water though and nose still feels irritated.

Council have checked out the system but cant find anything.

 

Thoses sticker ones are the ones that are causing the council a problem because they are telling ppl CM is leaking from the boiler when nothing is happening.

 

They have rechecked the boiler but nothing ive not had any symptoms since either.

What has made me swear also will come under what has made me smile but hey.

 

Since the 1st January l have been having notifications from equifax saying about my credit report.

 

So i am checking it out and hey since the fist on January Muck Hall has ben puting markers on a daily bases on my credit file. Now the only alleged debt they could be chasing is Studio cards with no vaild cca But hey why everyday since the beginig of them month? Ive been here 5 years not like i can wave a magic wand and the whole house will be somewhere else.

 

Oh well with the fact its muck hall must be getting close to the fact that studio are acepting they dont have a cca.

I am currently signed off from work suffering from stress and anxiety (which has been caused by work). I am usually the person that runs the payroll at work every month and because I wasn't there this week, the director of the company had to do it.

 

Unfortunately the company has 3 bank accounts. Lloyds, Abbey and RBS and when I set up the BACS payments for all the employees wages, I use the RBS account. The director didn't.

 

What made me swear today is that the bank details on the Lloyds account for each employee are not all correct, and this is the account the director used to pay everyone. Including me. Yep, my pitiful SSP wages has gone into my Halifax account which I had an arrangement to pay back the overdraft. And yes the overdraft was the same size as my wages. I therefore have NO money for the month :mad::mad::mad:.

I have rung the Halifax and a very nice chap told me that if I pop into a branch, they will let me have the money. Unfortunately when I went up town to do this, I discovered that the branch in my town has gone. The nearest branch is about 10 miles away and I just haven't got the confidence to go out that far yet :(

Clothing collection leaflets....I'd need to be a millionaire to donate to all the charities that shove leaflets through my door...Do they think I run M&S or have a sweat shop in my back garden so I must have a multitude of unwanted garments?

 

Most of them are bogus and it really get's to me that they are taking money from the REAL charities.:mad:

Indeed, but the white collection sacks came in handy over xmas and new year when we had no recycling collection due to snow to put the overflow in as we not allowed to use black sacks

Yup... DD has worked at this place for 15mths on renewed temporary contracts and is now currently out of work.. she was offered another 6 week temporary conract to go back starting in Feb...

 

Managers daughter has just been appointed a permanant position in the same department, doing the same job as my daughter, without having worked there before...

 

Btw, said manager is also head of the firms 'union'.... :rolleyes:

 

Daughter is now so disgruntled she don't wanna go back... :(
