    • Hi there Manager for our soccer sixes team moved overseas mid season and we struggled for numbers so we told the ref about 5 weeks prior to seasons end that we would see out these games then be done and he told us he’d ’pass the message on to the relevant people’. Heard nothing, then 3 days prior to the new season beginning we were given our fixture for that weekend. Told the guy over text we had pulled out and the ref should’ve passed a message on but we were told sufficient notice wasn’t given and it needed to be in writing. I argued it’s not our fault the ref didn’t do as he said but we were countered by the T&Cs.    now being chased for what was £608 kindly reduced to £476 to pay off remainder of the season. Been sent a letter in the post from their accountancy team and told needs to be paid by Friday.   seen a lot of the other threads saying we can literally just ignore everything but im concerned about debt collections and credit score being harmed. Can anyone confirm if this all works/what we should do?   thanks
    • Hi,   I have given an official police witness statement for the prosecution in an upcoming criminal court case, and I am very anxious about what might happen.  Specifically regarding being cross-examined.  My statement is very short, and only a couple of paragraphs long, regarding a conversation I had with one of the victims.  I have tried to research online about what information about me the defence barrister might be able to find and use to discredit me.  I have by no means have a shady past but, I am concerned about what private information might be brought up, and as this is a case that will be in the national press as it is in the public interest.  The two preliminary hearings were reported in the papers.   I have tried to research  online what information the opposition can seek, but it is all very complicated.  I believe that they can legally access public records, but I'm not sure what information public records hold.  Can they access my medical records, educational history, HMRC, and Department for Work and Pensions? (I am a self employed sole trader).  I was arrested once, and this was unfortunately instigated by the victim in this case, so could well be of interest to them.  It resulted in no further action, however I have only discovered this week that that, in fact, this means I have a criminal record, and will be so until I am 100 (no chance)! This has really annoyed me to say the least, especially since I asked him afterwards why he rang the police and he said 'for a laugh'.  So I have started to look into applying for it to be deleted, but again, if anyone has any advice on this I would be appreciative. At the moment, my name isn't on the confirmed list to give evidence, but the detective I have been dealing with has said it is 'likely'. The names of the victims in this case will not be allowed to be reported, are witnesses fair game for the press? I really need no know how deep they can delve in to my life so I am prepared if my character gets assassinated in front of the nation. I really wish I'd never agreed to this.   Many thanks
    • A belated thanks dx. Yes I may take your advice regarding StepChange. I am finding that I am telling them (on behalf of my Son) the true balances outstanding? They never seem to check properly in which worries me. If I was to take on myself is there another way of dealing with various debts? I have already submitted other IRL complaints on his behalf. Today I have received a further response from Quidie T/A Fernovo confirming that they will waiver all interest paid.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Next have a habit of sending blank agreements to show you what one would have looked like had you signed it. In a way they are complying to your CCA request because they are allowed to omit certain things like signatures, but as you never signed an agreement in the first place they could do little else but omit it. :rolleyes:

 

Just ignore them.

I'm trying not to let this get to me but i'm actually shaking i'm in on my own with my young son and a man just started banging at the door i don't normally answer the door if i'm not expecting anyone but he kept knocking constant really loud he obviously heard or seen my son at the window!! So i stupidily answered and a really tall well built man put a peice of paper in front of my face saying i owe next directiry £315 and he was here today to collect it he never even said where he was from i guess it will be something to do with debt managers as they have been harrassing me about this!! I told him i was disputing this with next as i don't acknowledge the debt and they have failed to come up with a valid cca then he started asking me all these questions like why are you disputing it, are you saying you never purchased anything from next, are you a tenent here and so on and i started getting all muddeled up i suffer from panic and anxiety attacks and i actually felt one coming on i was shaking and felt like bursting out into tears! It was just horrible and at the same time my young son started screaming and crying, I told the man i had to go and he said he will come back later :( i really don't want him to come back, I know i'm probably making a big deal out of this but i feel horrible, I can just about handle the letters and phonecalls but not this i live here alone with my son and i really don't want him banging at my door is there anything i can do, Please.

you are under no obligation to even allow him on your property.

tell hin to go away, if he does not, then call the police.

 

i'll look back in your threads to see if i can fathom out what this mightbe about.

 

but just be assured that ONLY a baillif on a court order has any knid of authority to collect debts on the doorstep.

 

a DCA collecting on a civil debt has NONE.

Ok. Calm down. You don't have to answer the door to bullies like this. Did he say what company he was from? Have you had any letters about this before?

 

If he calls again go to the door and say all communication in writing only and shut the door. If he keeps banging on your door and refuses to leave then call the non emergency police number which you should be able to find on your local police force website.

You do not have to put up with this intimidating behaviour. What this person is doing probably constitutes a criminal offence. If this creature returns telephone your local police and report a breach of the peace and threatening behaviour. This get has NO LEGAL AUTHORITY whatsoever.

 

You should also make a formal complaint to Next as they are responsible for the actions of thugs that are employed by the pond life that they use to chase debts.

Thanks for your replies my hearts pounding i just feel horrible, No he never said where he was from and i didn't think to ask but a dca call debt managers which is actualy based about 10 mins from me have been sending me letters about next i cca'd them and in there last letter they said they couldn't get a copy of a cca and offered me a discount!! I just left it but then next sent me what they said was a valid cca but it wasn't it was just a bad photocopy of terms and conditions there was nothing else on it no signiture or anything!! So i was advised just to ignore that to this was about 2 weeks ago and i've heard nothing until he turned up today!

I totally agree with the other posters. Do not open the door if he comes back and if he won't leave your property then call the police immediately.

 

The fact that you have a young child makes this even more disgusting!!!! :evil: I get so annoyed that companies think they can threaten and scare people!!!!!!:evil:

 

Also DO NOT LET HIM IN UNDER ANY CIRCUMSTANCES.

 

It might be best to CCA next to find out what is going on? This will cost £1 (postal order and NOT cheque). Do not sign the letter either, print your name.

 

I am sure a more experiences cagger will come up with the letter

If it is not a signed CCA agreement and just terms and conditions then the debt is not enforceable.

Cause this has really got me into a state it was just the way he spoke to me and the tone of his voice i haven't had a panic attack in about 8 months i've been doing so well and i can't believe i nearly had one because of him, I'm trying to get hold of my brother just to come to the house for the night cause i really don't want to be here alone and it's not fair on my little boy me being in a state like this.

You can record the incident to the police then if it happens again the police will know that this is a reocurring incident. Therefore if you decide to complain about them you have evidence from the police.

 

Also the fact that you are a woman on her own with a young child is something you can "play" on. If he comes back phone the police, them them you are on your own with a child and that a strange man keeps banging on the door!

If he comes back do not answer the door and call the police. Try to take his car reg number so you can give it to the police too.

 

I would love someone to come to my door and give me abuse just to see the look on their faces when they see my dog.

If the ****** comes back, and if you have one, use video recording on him. Film him with a phone even if it doesn't have video capability just say you are filming/recording everything. This type of filth don't like to be filmed or recorded and will change their tune if they are.

Do you know any coppers ? any of the parents at your child's local school policewomen/men...only reason I am stating/asking is that I did hear of one cagger who was in a similar position and she went to the local police station and the one of the coppers there rang the doorstep collection company and asked when they would be there again as they (the police) wanted to be in attendance...I don't believe they ever heard from them again....

 

A letter to the DCA sent recorded might be a good idea too

Any threaterning behaver to you or a child is an offence and once it is logged as a crime the Police HAVE to deal with it or it goes down as an unsolved event and it cocks the statistics up...
