      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I haven’t been on here for quite a while. Despondent at Egg's replies and I’ve let things slide so now its getting much more urgent. Family difficulties and health issues are poor excuses I know. I'm aware I should have done more sooner.

 

I got the info from Egg that I requested earlier:

 

My Egg card agreement is dated: 16.2.2005 but I am certain that the card was taken out much earlier than that. I haven’t been able to find any evidence to back this up however. My card account was terminated on 3 Aug 09.

 

My Egg loan agreement is dated: 7.9.2005 when I consolidated my loan and card debt with a new loan. A pity but cant be helped.

 

Nasty calls all stopped long ago and then I had a solicitors letter on 22 June 09 re the loan and recently Frederickson International have called. V nice soft approach asking for a small payment to 'keep the account open'. My instincts led me to say I couldnt manage even that (true). Did I do right?

 

Now I need to know if there is anything further I can do in the circs? All I own is my car which isn’t worth much and I have a mild disability so living up a hill and frequently visiting my mum to help her care for my aunt who is seriously ill means that I need transport as they don’t live on a bus route.

 

All advice appreciated as ever.

Get all te information from Egg - send a CCA request to Fredrickson asking for copy of executed agreement and statement of account under s77 of the CCA 1974. Send £1 statutory fee and remind them that the statutory period for their response is 12 working days.

Did Eggput any charges on your account for late payment, etc? If so, start a claim to get them back (it doesn't matter that the account is closed - charges are unlawful. Full stop)

 

CAn you post the loan agreement here (personal details removed) so we can take a look?

No they are not the same - the CCA is a specific request for a copy of your agreementg and statement of account under s78 of the CCA 1974, the other a request undr the Data Protection Act 1989 for all data they hold on you

When I clicked on the blue SAR link I only found a standard letter template to a bank. You are advising me to send my SAR to the Debt Collection Agency.

Is this template the one to use to them? Does it need editing at all for that purpose? Also do I sign it? I have seen conflicting advice on that in the forums.

Can I send a copy of a utility bill instead of signing? That worked when I requested the CAGs from Egg.

What do I say when Fredericksons next call me? They are doing this every 3 days now and asking for just a small payment. I assume I shouldnt make one?

They asked me for details of my financial situation so I have filled out the budget spreadsheet. It looks dire. Do I enclose it with my SAR or is there any reason I should send it separately?

Sorry to ask such basic questions. I'm a pensioner and find this confusing but I'm learning my way around slowly.

Just found the 'Debt Gollection SAR' letter so You can ignore that part of my post. Also the one about a signature.

Just need advice re what to do about calls from the agency (which are v polite and friendly - not like the snarling scary ones from a previous one) and whether the spredsheet should be sent separately or not.

I hope to get my CARs onto disc at a printers and then I can post them here. Any particular size and format for doing that?

As suggested in May Egg did sell my debt(s) on so I have heard from a number of collection agencies. Some of these were nasty and some very nice. I have politely but steadfastly refused to play ball. I just tell them the truth - I am a pensioner, I have no savings any more, I rent my flat and have sold everything I have of any value. Once they realise its a blood and stone situation they leave me alone - until the next one.

 

As nothing has happened apart from phone calls and letters I wonder if Egg sold me on because the agreement is unenforceable?

 

cc agreement uses word 'credit' Loan one says 'Personal Loan' (Egg photocopied too small and the docs came up as thumbnail size on the forum so arent posted here). I have them on photobucket if ou want to take a look PM me.

 

As Egg are now out of the picture how do I proceed? Dont want this hanging over me for ever. Supposing I won the lottery? :rolleyes:

 

Any help you can offer or any direction you can point me in to get more help would be greatly appreciated as is your time in reading and replying to this message.
