Hi newbie here - could anyone help and let me know if these documents from Barclaycard re a CCA are enforceable please. I have read your agreements vs Applications thread, however just wanted some clarification if possible.

 

They have come from 1st Credit who have been an absolute nightmare and I have now sent them the harrassment letter, and the calls have eased off slightly, however when I submitted the SAR request this is all I have received so far to 1st Credit.

 

Could you let me know if this is a valid CCA

 

Would really appreciate the help.

Hi there,

 

As the interest rate, a term to define the credit limit, how repayments are structured and your signature are present on the application form then it would be enforceable.

Have you received a Default Notice & Termination Notice?

Make sure you do not post anything which identifies you. Although we can remove certain things from the site unless it's done in a timely manner everything you post will appear in Google cache & we do not have any control over that.

Hi Guys - first of all thank you.

 

I think Barclaycard would have defaulted me as I could not repay my monthly installments for 3 months, hence the reason 1st Credit now have the debt. Ist credit have sent me a letter saying "we attach an edited copy of the signed agreements" I am not sure what this means. They have also sent me a letter of assignment from Barclaycard to 1st Credit. There have been significant charges onto this account which I am reclaiming back so this will reduce my debt. 1st Credit keep changing the amount I owe so I have sent them the £10 and am awaiting the SAR information.

Barclaycard should have sent you a Default Notice which would have allowed you to remedy the a/c, hopefully it might show up in your SAR.
