Is my MBNA Personal loan agreement enforceable?

Without a signature, it cannot be enforced. You should write and thank them for complying wit your request under s77 of the CA 1974 (the agreement poste above does comply with that) but point out that what they have sent is unenforceable because it doesn't have a signature on it.

OK, you have your original customer copy.

 

To see what agreement MBNA hold, you will need to request a copy from them.

 

This will cost you £1.00.

 

Send them letter 8 - The Consumer Forums - Debt collectors

 

Amend to suit, do not sign, enclose £1.00 postal order and send by at least Recorded Delivery.

If the loan agreement had been agreed online but there was no signatory documentation to back it up would it still be unenforceable? Also if the credit company has admitted PPI mis selling and paid compensation, is the agreement still enforceable
