    • ok again thanks for all advice , im going to continue and struggle on paying the wifes debts and maybe look at getting reduced payments but as for mine i think ill go down the DRO route and try get it sorted but will see and open new bank account somewhere first
    • Nothing to do with your own Bank.     Try to withdraw the money from Parentpay early next week and if no joy contact them.   It may be that the money is showing, but has not fully cleared on their system,

These terms are from a contract at a similar time to when Tracey started as we think they have changed since.   The contract reads as follows:   Termination of employment  Xxxxxxx (Nursery) will provide written notice of termination of your employment in accordance with statutory requirement (currently 1 week’s notice for each year of continuous service, up to a maximum 12 week’s notice).   Once you have successfully completed your probationary period for the company you are required to give 1 month’s written notice of termination of employment.   Regards   Matt

    • I thank the Consumer Action Group Members for getting me this far in my case which is still in progress.   Situation: The Court has reversed earlier permission for me to rely on witness summaries.    The question upon which I am seeking help, please,  is - do I need to bother myself as to why the Court has reversed permission to rely on witness summaries?  If so, what line of logic or law can might I follow because clearly, the Court has said one thing and then another a few weeks later, of its own motion, the Court has reversed the earlier decision. I find this development quite extraordinary in the sense that as a result of being granted permission earlier, I served the three Witness Summons which had the Court stamp.   Background Having given me permission to serve 'Witness Summons' which I served on 3 hostile witnesses several weeks ago, the Court has now reversed it's earlier decision, and refused me permission to rely on 'witness summaries' pursuant to paragraph 32.9(2), citing that I have not shown steps taken to obtain witness statements from the 3 hostile witnesses.  I however, made two attempts to talk to the hostile witnesses who have been non responsive and I can evidence this.   I would be immensely grateful for some steer from Forum Members, please.

      I was in Sainsbury’s today and did scan and shop.
      I arrived in after a busy day at work and immediately got distracted by the clothes.
       
      I put a few things in my trolley and then did a shop.
      I paid and was about to get into my car when the security guard stopped me and asked me to come back in.
       
      I did and they took me upstairs.
      I was mortified and said I forgot to scan the clothes and a conditioner, 5 items.
      I know its unacceptable but I was distracted and Initially hadn’t really planned to use scan and shop.
       
      No excuse.
      I offered to pay for the goods but the manager said it was too late.
      He looked at the CCTV and because I didn’t try to scan the items he was phoning the police.
       
      The cost of the items was about £40.
      I was crying at this point and told them I was a nurse, just coming from work and I could get struck off.
       
      They rang the police anyway and they came and issued me with a community resolution notice, which goes off my record in a year.
      I feel terrible. I have to declare this to my employer and NMC.
       
      They kept me in a room on my own with 4 staff and have banned me from all stores.
      The police said if I didn’t do the community order I would go to court and they would refer me to the PPS.
       
      I’m so stressed,
      can u appeal this or should I just accept it?

Another First Plus Ppi......

Yes I have one, I have been busy reading through all the various threads on this subject, and read through all the paperwork provided by Firstplus. The only basis I can see on my PPI for mis-selling is the fact that they did not advise over the telephone that there were other PPI's available or on the market. In addition to this I don't appear to have received the payment protection policy.

 

The terms and conditions clause 18, some statements within clause;

''Upon the 5th anniversary of the PP plan you will need to send in a written claimwithin 30 days of the natural expiry of your PP Plan''.

''you may be entitled to a cashback payment of an amount equivalent to your insurance premium as stated in this agreement''

''This refund does not include a refund of interest you have paid on the amount''

''you should contact the Customer care team on (tel number) within 30 days of the expiry of your policy''.

 

Few things with the above, I am asked to put the request in writing and also to contact Customer services team aswell. When sold/offered the policy I was advised that I would get the full amount back after the five years, as if it was money in the bank, just like saving the same amount, obviously without getting the interest back:cry:

 

Anyone think this is worth pursuing, my policy is due to expire in 17 months time feb 2011, amount is for £6,776.20 on a loan of £34,000.00 interest at 8.4% variable.

I'd say its worth pursuing - some of the people on here with Firstplus seem to have had offers ....

 

My claim for PPI was around £5,500 for the actual policy but with the interest they charged me on it and the 8% interest I charged them for the misselling, I am trying to claim back around £11K. It amazed me how much it came to with all the interest added. So its definately worth trying.

 

I'd send a SAR request now (templates on Stickys at top of page). Whilst you wait for the reply you can be getting your claim ready and working out all the figures. Plus waiting for other comments/help on here.

I have just sent them a request for the PPP policy document and advised them via e-mail that I consider they have miss-sold the policy to me as they did not advise either on the telephone or in writing that there were other similar policies available. I await their response. Have also just completed a SAR letter that will be going in the post tomorrow.

go for it yesterday i got a letter from the ombudsman and i won my case against first plus my loan was for £34000 my p.p.i was £6,776.20. he stated that first plus have to reset my loan as if i had not taken out the p.p.i. and he also told first plus that they have to pay me £500 in compensation, if they offer you a goodwill gesture don't accept it, the ombudsman stated in his conclusion that the p.p.i policy that i purchased could have been purchased much cheaper elsewhere and first plus did not tell me that so good luck:D

Thats good news, so you get £500 compensation, but what happens to what you have paid in so far, and does that subsequently cancel the policy?

It cancels the policy. One of the site team here referred me to British Insurance(ers?) - google them, they are really cheap so you could PPI from them instead.

 

You have to work out the figures. If you are any good at Excel there is a PPI spreadsheet at top of PPI forum in Stickies that is good. If you don't know Excel then someone on the site may help you but they'll need you to post all info including date of first payment and number of payments made.

 

I've been told that the cost of the policy will be refunded into my loan but I will get the rest paid to me in a cheque. Think it works out at about half to loan, half to me. But not sure if its different if you have arrears. That's all if I win of course!
