Can see this turning into a big nasty...! :D

Basically, got a parking ticket for loading in a loading area during

permitted hours whilst...... errrrrrr... LOADING!!!

Have got loads of pic's and have already received disclosure of a

Freedom of Information Act request which reveals a problem with

the Traffic Regulation Order.

Pic's later, for now the ticket itself....

img116.jpg

Shouldn't that be....

"date of alleged contravention"

and

"time of alleged contravention" ??

And, yes, I'm aware that the contravention code is wrong..

Well, as you see the PCN issued at 11:04am for code 01...

which is... restricted street at restricted time...

Obvious that I was unloading and correct contravention should

have been 02 - ... whilst a loading restriction was in force...

Had a restriction been in place!!

Not Rocket Science is it?!!!

Photo005.jpg

I always park next to the plate at this customer so that it's obvious

that I shouldn't get booked!!! The irony is that I'm actually delivering

to Manchester City Council!!!!!

Photo007.jpg

The Traffic Regulation Order (TRO) shows that only a single yellow line

with no loading restriction should be painted here!!!

It may not be rocket science but it may help if you could tell the time 11.04am is AFTER 10am so why is the contravention wrong, its only no loading until 10am?

The CEO has issued on the premise that the vehicle is a car..

And that the car was in a restricted street at a restricted time..

Had she issued correctly, had a restriction been in place it

should have been Contravention Code 02. But as it was after 10am

there was no contravention.. Thus ticket issued incorrectly.

But as this is Manchester City Council, I expect a fight to the death

before the ticket is cancelled...

The CEO has issued on the premise that the vehicle is a car..

The is no distinction between types of vehicle for parking on yellow lines the restriction applies to all vehicles unless exempt in the traffic orders.

The vehicle is quite clearly a 7.5 tonne and is clearly liveried

and is clearly unloading, as actually observed by the female CEO..

which CCTV will back-up.

I don't know many 7.5 tonne cars... Maybe a stretch Hummer...?

A goods vehicle is a goods vehicle, as distinguished by TRO, for example,

"Goods Vehicle - Loading Only"..

I thought you were a driving instructor!! A white timeplate refers to the kerb blips ie the loading restriction.
