On 20 December 2008 we purchased a Candy washing machine from Comet, along with the extended warranty of 5 years £428.99

 

On 15 May just 5 months later the machine has a problem with the main PCB which we call the service centre have to wait the usual 2/3 days for the engineer to call then he diagnosis the problem and orders the part another 3/4 days and another engineer arrives with the new part.

 

May machine is fitted with selector switch and PCB

 

30 July another main PCB is fitted

 

August 10 Just 2 weeks later on the same problem occurs main PCB

 

We ring comet service and ask if we can have a replacement machine as this is the 4th time in a matter of weeks the same problem is happening and it is very inconvenient the chap agrees and said that they have to send an engineer out to asscess the machine to see if it is the same problem and if it is then he can ring us and we will give him a reference number for us to take into Comet to get a refund.

 

The engineer arrives today confirms that it is the main PCB again and agrees that we cannot go on like this, but says he is unable to call the service centre as they do not have the facility to do this.

 

Ok, so he goes we ring the service centre to be told we are not prepared to replace the machine or refund it we will come and replace the part..

 

We try to speak to several managers who say the chap that said we could have a refund was wrong to say this, and basically they are refusing to refund/replace the machine...

 

Where do we stand please?

 

I actually do not want the same model for fear of the same thing happening.

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

But we have told the Manager at the call centre this and she claims we are not getting a refund, they will come and repair the machine when we asked to speak to her manager she said there wasn't anyone above her. she apparently was the manager!!

 

we even quoted her the SOGA and she STILL will not refund/replacement, in the end we ended the call saying we would got to watchdog she didn't seem to be bothered.

 

so here we are with a machine that's broken and comet service centre wont refund/replace what is the next course of action?

 

the lady said you have to do what you have to do we are NOT replacing it

Call Consumer Direct to report it.

 

And before a certain someone comes along and starts off about it being a waste of time, Comet are under a scheme whereby TS will tell them what to do and Comet have agreed to do it.

Alternatively, since CD won't do anything direct'y to assist YOU, the best advice it so move things along with YOU in control.

 

You need to put your complaint in WRITING to Comet, explaining the issues in shortened form and stating you are rejecting the goods under the Sale of Goods Act - and look forward to their proposals to resolve hte matter.

 

Your extended warranty should not be an issue within the first year as this is covered by the manufacturer anyway.

As do I - why waste your time dancing round the maypole when you can kick them into action on YOUR behalf, instantly by starting a paper-trail that can be used in court to sustain a claim. (Something letters to third parties do not). Don't delay - eime is always of the essence, something that ConsumerDriect have no grasp of.

Ah, Gyz, don't let the ignoramus get to you, there's nothing that would please him more than to be able to keep on spouting unchallenged. Keep on giving the correct info and trust people will be able to see the difference, that's all you can do on an Internet forum. ;-)
