    • Potentially it may not even get sold on? Just the default left for 6 years then gone? but if it is sold on ill get a letter from the DCA which is the notice of assignment? Sorry what is the different between a default notice and a default cal marker? yes, i may try and work arrangements out with the OCs after the breathing space but I'll see my circumstances then thank you again for all your help and patience, I really appreciate it and apologies If i am too fast or repeating myself.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I've just read Karne's post in the Abbey forum about making sure we read the order from the judge correctly, so am posting my order here. Any advice is more than welcome! So far i've taken the court bundle from the library and that's it. I think I need to also prepare a witness statement but am a little stuck as to how to go about this.

 

Here's what the courts have asked me to do:

 

Within 21 days of service of this order all parties shall send or deliver to the other party and to the court written statements, which are signed and dated of all the evidence including their own (and including any documents) which they intend to rely on at hearing. No party shall be at liberty to give evidence or call any witness whose evidence has not been diclosed in this way wihout leave of the trial judge. All parties witnesses shall attend the final hearing unless it is agreed by all parties that their attendance is unecessary. The district judge will review the file at the expiration of the time allowed for the filing and serving of evidence and if any party is in default in complying with any of the directions in the case, he or she will make such order as she or she thinks fit, including if apprioriate striking out the Claim or any Defence

 

I'm going to carry on having a look around the forum for ideas - if you can help me then I'd be most grateful!

1. Can anybody tell me if I need to add anything else in light of what the judge has asked?

 

Also, I've read about people highlighting various parts of their bundle. I was planning on hgihlighting my statements to point out the charges.

 

2. Do I need to highlight sections of the Acts and case law summaries I have included?

 

3. If so, which parts?

 

I want to get this submitted on Thursday so that it's out of the way so your advice is appreciated. Anybody?!

I guess the specimen bundle prepared by Bookworm should be considered as a minimum. There are new documents and bits of info being unearthed all the time. Like the report from the Competition Commissioner into banking in Northern Ireland, articles in the press etc. I haven't looked at the bundle recently to see if its been updated with the latest stuff.

 

What i would say is that if you have prepared the basic bundle then it would be fine. However, if you have the time and inclination you could strengthen the basic info by adding the latest info, articles etc. Its difficult to say go here, because as usual the links are everywhere and to an extent its up to the individual to track these things down.

 

2. Do I need to highlight sections of the Acts and case law summaries I have included?

 

Do you mean in all copies? I think the answer is no, you use your copy in the way you see fit, you let the judge and the defence worry about their copies.

 

I would use some form of index at the front and perhaps use tabs on documents which you specifically want the judge to see.

 

For example i don't suppose for one minute he would give your statements anything other than a cursory glance, but he/she may be very interested in the OFT report for example and it would be good to help them find it easily.

 

3. If so, which parts?

 

Bearing in mind the potential number of statements it may be wise to highlight the charges, but personally i don't intend to highlight every paragraph in every document that i will present in my court bundle when the time comes.

Hey guys - was about to post off the court bundles when I figured I may as well phone Inga and see if we could settle - she was very nice as was the other chap I spoke to. Have settled for total minus about a tenner which is great as the P&P would have cost more than that!

 

Be glad when the cheque is in my hand - keep going and you will get what is YOURS
