Apart from SMT37 (http://www.consumeractiongroup.co.uk/forum/debt-collection-industry/165349-smt37-morgan-stanley-goldfish.html) has anyone else gone as far as getting the court to order a creditor to produce the signed agreement?

 

I'm getting close with one of my creditors in that I sent cpr letter 2 and gave a dealine of the 17th of August which is only 3 days away.

 

What would be my next step, I've read PT's thread ( http://www.consumeractiongroup.co.uk/forum/legal-issues/173201-why-you-shouldnt-use.html ) and I want to make sure I don't get hit with costs.

 

PT what would the costs be should the judge not rule in my favour?

I've sent my first letter quoting CPR31.16, and I will ask the court for permission to make an order for disclosure using this section when proceedings start properly.

I could also use some more info on this!
