Hi

 

I have been reading through the cca under the default section and it states that no monies can be recovered on outstanding debts unless the relvant defualt notice has been issued and correct procedure followed.

 

With this in mind if a company has taken money from my card in relation to an outstanding sum from 2007 without even sending me a default notice is this not a breach of the act?

so a co has just taken money from your bank using your card details without your say so?

 

if so get the card stopped now.

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

It is to do with a loan i took out in 2007 where i had to provide my card details as part of the application. The loan went into dispute due to various charges added but i always maintained the fact i would pay them back the original amount.

 

I recently applied for a another loan with a company which turned out to be a different trading name of the company i took the original loan out with back in 2007. I used my current card details and 2 days after making the application they took a toal of £220 from my card. After speaking with them they just said as i owed it them from a previous loan they could just take it.

 

That s where my question regarding the CCA comes in as it is my understanding they have to put the account into default before any form of collection activity can take place.

no they cannot do this!

contact your bank and tell them you have a fraudulant transaction and get it reversed.

 

you need to contact the OFT & FOS and tell them too.

 

matters not about CCA or anything, its a diff company altogether.
