    • I'm not sure we were on standard tariffs - I've uploaded as many proofs as I can for the ombudsman - ovo called last night uping the compensation to 100 from 50 pounds for the slip in customer service however they won't acknowledge the the problem them not acknowledging a fault has caused nor are they willing to remedy anything as they won't accept the meter or formula was wrong.   I'd appreciate more details on the economy 7 approach and I'll update the ombudsman with any information you can share. 
    • To re-iterate and highlight my urgent question on this one: The N24 from the court did not include any instructions to submit paperwork 28 days before the date, unlike the N157 received for other smaller claims. Do I have to submit a WS for this court date? Link has!...
    • No, reading the guidance online it says to wait for a letter from the court. Should I wait or submit the directions? BTW, I assume that the directions are a longer version of the particular of claim accompanied by evidence, correct?
    • Thanks for opening, it's been another rough year for my family and I've procastinated a little.. Due to the age of my defaults on this and other accounts (circa 2021), I really need to avoid a CCJ as that will be another 6 years of credit issues. Mediation failed as I played the 'not enough info to make a decision' however during the call for some reason they did offer settlement at 80%, I refused. this has been allocated to small claims track, court date is June 3 and I've received their WS. I'm starting on my WS. They do appear to have provided everything required of them (even if docs could be reconstructions). Not really sure what my argument is anymore but I do want to attend court and see this through. Should a judgement be made against me then I will clear the balance within 30 days and have the CCJ removed - this is still possible isn't it? I'm going to be reading up today and tomorrow and hope you can provide me some guidance in the meantime. Wonder what your advice would be given the documents they have provided? I am now in a position to clear the debt either by lump sum or a few large installments - Is this something i should look into at this late stage? Thanks as always in advance
    • I have now received my SAR. It includes a great deal of information! Is there a time limit on how long account information is kept and/or can be provided to debtors? I have received many account statements which were not previously sent to me. I remember that the creditor should provide explanations of any acronyms and abbreviations that maybe used in the documents. Is this still the case? Also what, if any, are the regulations in regard to adding fees to a debt? Can fees be added to a debt after the court has approved a charge on a property. Perhaps due to the numerous owners of the debt, many payments I made were not properly recorded on the account, some were entered over a year after the payment was made! Following the Legal Charge, I paid every month until my payments were refused. I am trying to compute the over payments, but the addition of fees etc. is confusing me. Any comments and/or help would be appreciated.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hello,

 

This is on behalf of my sister who is on income support, a single parent with a disabled child.

 

In Aug 2005 she moved into a new house. United Utilities setup 2 accounts instead of 1.

 

From the word go she recieved letters stating the acount was over due. She kept paying these demands but they never stopped the letters. The letters got worse with threats of legal action. She struggled to pay and fell behind.

 

They passed it on to a dca in 2006 who also threatened legal action. She complained at this point but they seem to shrug it off. She started paying the dca and in mar 2007 got a new bill in from UU so was trying to pay both (arrears and new yearly bill). She received more demands from UU and again got further behind with payments as she could not pay what they were asking.

 

In nov 2008 the took her to court and got a ccj. She had to pay the ccj and the UU bills still coming in.

She struggled to pay the ccj and uu at the same time and then in july 2009 she got a further demand and threat from UU that she was 700 in arrears even tho she had just paid.

Again she complained but this time they stated that there had been an error and they had created an additional account in 2005. She did not owe them anything but they owed her an over payment of £1100 and that she should never have been taken to court.

 

They offered 200 in compensation and have set aside the ccj.

 

However for 4 years of threats and demands, a ccj and damage to credit file 200 was not good enough.

 

So under section 3 of the protection from harassment act 1997 I have started a claim against UU and damage to credit file .

 

I will update as and when i get more info

Good on you, £200, didn't they forget a zero somewhere.

 

Don't forget the interest on the £1,100 (compounded) that will be a few hundred so they haven't actually offered anything in compo.

 

Did they offer a refund or to attach it to the other bill?

just an update.

 

To answer conniff, they took this years bill in full and gave her back the remainder.

 

A claim has gone in and as my sister is easily intimidated I have put my address on the N1 (for service of docs) however the solicitor has started to send docs straiht to her, it was only a copy of the acknowledgement of service but for one there was no need to copy anyone but the court nevermind my sister at an address they arent to supposed to send docs.

 

also I sent a sar but they stated they recieved it 11 days after posting. I do have proof they lied as I did recored delivery.

 

oh, they intend to defend the whole claim (even tho part of the claim is costs associated with the wrongful ccj).

Absolutely - United Utilities are a horrendous company! Contact the media, your MP, everyone - we need to get together and make sure UU lose their contract.

 

 

I have been considering contacting bbc northwest or granada. I was unsure if this would affect the claim.

Little update,

 

They are now playing silly buggers as they have sent a letter stating they require identy for the sar request, once received they will have 40 days.

 

I will reply with a ' you are aware of her identy as you have took her to court and she is taking you to court so stick your identy' letter. The clock is unchanged as far as I am concerned and they have until 11th sep to comply or its off to court to force them and claim further compensation.

Another update.

 

No reply to SAR so have today sent an LBA giving them 7 days to comply. Have already got the claim ready to send.

 

Also concilla (there in house dc) have no consumer credit license to collect debts and they cant use UU's license as UU do not list Concilla as a trading name (thanks to pelham http://www.consumeractiongroup.co.uk/forum/general-debt-issues/50906-concilia-debt-recovery-no.html#post1693409 ). So I will be including that aswell. :p

 

Also will give it a couple of weeks (as expecting their defence and to see what Mr MP does) and then I will contact BBC Northwest and ITV Northwest

Well received a letter from UU stating they will not comply with the SAR. So in 6 days another claim will be entered against them.

 

I have made a complaint to the ICO in which I have made clear that UU's request for further ID is unreasonable as there has been a long standing relationship between UU and the data subject(at the same address) for at least 5 years which include dozens upon dozens of letters, phones calls, A CCJ and a large payment made to the data subject.

UU cannot claim they are unsure of the data subjects ID when they have already taken them to court and made a large refund aswell. In addtion they have also received a claim for harassment from the data subject.

 

I now need to know, do I proceed with the new claim for failing to comply with the SAR or do I use CPR part 18 with the current harassment case. Their defence is due in very shortly and I still need the info requested in the SAR?

 

Any advice is helpful?

Thanks 42 man for the links, however I'm a bit stuck as to how to proceed.

 

As the info request in the SAR directly relates to the current harassment claim can I as claimant ask for it using cpr 18 ?

 

I know I could just send further ID but they have had enough time already (more than 40 days) and they know perfectly well who the data subject is.

 

Any advice appreciated

Little update, have contacted the BBC Northwest tonight programme. Hope to hear from them soon.

 

Still wouldnt mind some advice on what to do in regards to getting the info from the SAR.

 

Which one should I do?

1) Start a further claim (which will take forever)

 

2) Send the ID (and wait another 40 days)

 

3) Ask for the info using CPR part 18 (and give them 14 days )

 

Edit: am I even allowed to use part 18 as the claimant?

 

Advice anyone? :)

CPR31.16 might be a good way to get them to reveal documents.....I think you'll understand if you read this - although this is biased towards obtaining your agreement I THINK the principles are the same...

No problem, i'm not saying it is the best way, and i'm no expert on the pre action protocols...you might like to drop a user called surfaceagentx20 a PM as he is great on pre action CPR's.....You need to state a pobbiel just cause in the CPR31.16 too, but it seems you have one....but I think some legal advice from a solicitor really would be a good first move....

Defence has arrived.

 

Am I allowed to scan and place it on here? Further advise appreciated.

 

In Short:

 

1)They admit wrongly pursuing her for four years and setting up an account that she was not responsible for however deny that it was harassment.

 

2) They admit wrongly issuing court proceedings and obtaining a CCJ.

 

3) They state that as my sister admitted the ccj their actions were reasonable as they were like minded. (the truth being she was freightened to death of court).

 

 

4) they invite me to amend the claim so as to show the defendant as " united utilities water plc" rather than united utilities group plc" ---- how do I do this?

 

5) They put us to strict proof of:

 

a) My sister is single, on IS and has a disabled child.

b) That she moved into the premises when she stated. (july 2004).

c) that she suffered financial hardship, stress, anxiety etc due to their actions.

d) That she had to pay post office counter charges when paying the wrongful ccj.

UU have both 'United Utilities plc' AND 'United Utilities Group plc', so you could mistakenly get the wrong company. I suggest you either use the name on the CCJ that they got against your sister or look on the invoices/letters received. These should state the copmany registration number which is the definative way of identifying the correct company. 'United Utilities plc' has a number of 2366616 AND 'United Utilities Group plc' is 6559020.
