    • Our price is the same all day, but varies day to day. Yes there's a risk of high prices but it has never gone above SVR any time since I signed up. Last 30 days average 17.67p/kWh, max 20.67 and lowest was 11.83.  It saved just under £300 during 2023.  
    • It you had E7 in the past but have converted to single rate then the meter will still hold the last recorded Night readings. This introduces scope for error when manually reading. If the meter has only ever been used on single rate then there's only one figure that can be taken. For example ours shows "Rate 1" reading and a "Total import" reading, but they both give the sme figure. If it has ever been on E7 the total will be higher, including the retained night reading.
    • okay, perfect and thank you so much for the help once again. so firstly i am going to initiate the breathing space, during this time it's likely ill receive a default. when i receive the default are you aware of how long it will take for me to know whether the OC have sold it off to DCAs? Once it's with the DCAs i do not need to worry as they cannot issue a CCJ only the OCs can Even if i decide to come an arrangement with the DCAs no point as the default will remain for 6 years paid or not paid I should only consider repayment if the OC still won the debt and then issue a CCJ? Just to confirm the default will not be seen after 6 years? No one can tell I had one then after 6 years ill be all good?
    • I'm not sure we were on standard tariffs - I've uploaded as many proofs as I can for the ombudsman - ovo called last night uping the compensation to 100 from 50 pounds for the slip in customer service however they won't acknowledge the the problem them not acknowledging a fault has caused nor are they willing to remedy anything as they won't accept the meter or formula was wrong.   I'd appreciate more details on the economy 7 approach and I'll update the ombudsman with any information you can share.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi all,

 

i was hoping someone could help me. natwest charged me on 16th july for a unpaid items fee. firstly i am on a student account with natwest. now i am not debating the charge as at the time i was £7.00 short of the direct debit for my rent, although i did ask natwest to extend my overdraft by a tenner for a 2 days and i was happy to pay interest on this 10 pound extra until i could pay it back which would have been 2 days max. anyway after i was charge i thought i would let the bank know i was unhappy with how i was treated by them (and too be honest a cheeky atempt to get the charge reversed.) now i haven't hear anything of them even though its been 3 weeks since i sent the letter and i haven't been charged yet off them. in the letter they sent to tell me that i was being charge on the 16th july, they said it would be 21 days until the charge happened, which it has been.

 

i am quite confused of what i can do because id like to know when i will be getting charged of them so i can make sure that it doesnt affect this months rent.

 

i hope this makes sense (not the best typer) and if anyone can help me then it would be appreciated.

looks like they agreed it was wrong and did not charge you the unlawful fee?

 

i take it you have online access to your a/c?

 

p'haps a browse of the natwest forum might throw some light on the correct period before they charge [if you have it wrong] or p'haps the website has any info on charges period before they claim it?

it says this on there website

 

"From 1 June 2009, we will be changing the dates on which we deduct any Paid Referral Fees,

Guaranteed Card Payment Fees and Unpaid Item Fees from your account to align with your charging

period. These will also be debited from your account 21 days after the charging period in which they

were incurred (or on the next business day if this is Saturday, Sunday or Bank Holiday)."

 

so i am guessing it will be tomorrow thats its took out of the account.

 

aonther quick question, i called into the branch just before it happened to see if i could extend the overdraft, the reason they told me i couldn't was because it was a student account and it was a set limit. the woman said it was like a brick wall they just couldn't go over but wouldn't they be going over it with this charge? as it will go over my limit.

 

i also read about the hardship refund? being a student would i be able to use that? i read it could be hard with that though as most get refused? would anyone be able to shed any light on it for me?

 

can i also just add that having just found this website tonight and reading through it, its a fantastic website and the people who made it and contribute to it really deserve a pat on the bank and i will definetley be making a donation soon as i get spare money into my account.

as for the o/d limit..welcome to the real world, they can do whatever they like, we as mere mortals have to lick the lid.

 

hardship. now, i wouldn't think rent [ as the council cant send in the boys] would be a good enough reason, now, if it were council tax, that would be a diff matter, just post them a copy of the - here come the bailiffs letter and they will cough up.

 

you could try, not saying you won't grow fruit, but typically banks want four? diff arrears letters from you debtors for that period before they even consider it. if more than this one charge [past] are involved then maybe.

Hi everyone,

 

i have seen that natwest have charged me £38 in the past few days meaning i didnt have enough money again for the direct debit for my rent, in fairness to my landlords they have been really good and will come up with a different way to pay the rent, but it means i will have another charge now again of natwest and it is becoming a bit of a joke!!! i was wondering if anyone knew where i should send a letter t because i have already sent one to the branch and got no reply!! or shjuld i g in t the bank and demand to see the branch manager??? also i am thinking now to move to another bank but because i will now have one bank charge pending will i be able to move the account to another bank? or will i have to wait for the next charge 2 come into my account to change??

i sent a letter to natwest the other week and i have got thier response today. without typing it all out out here ill try and give the jist of things. it basically goes on about how they think these charges are fair n lawful etc. and how they are in the middle the test case and in the in's and outs of that (how they appealed this hearing and that hearing) and how they can't respond fully to my complaint now until the test case finishes.

 

now it says on it that if i want to refer it to the FOS that they have asked to FOS not to proceed with any other case until to test case is resolved and that the FOS have indicated as a general proposition that they won't proceed with cases which rely on the legal issues being considered in the test case.

 

it says if i wanted to issue a claim to the county court that the master of the rolls has issued guidance to the county courts suggesting they stay proceedings about bank charges and that similar guidance hasd been given to the county courts by the test case judge. and that whilst theses "stays" remain in place claims in the county court will not be heard. it says if i bring a new claim they will put it on hold automatically or the bank will immedietely apply to the court for an order to stay the action until resolution of the banks proceedings with the OFT

 

now i am confused about what i should do next. i'm about to send a letter before action but would it be worthwhile sending it now or should i wait until its all resolved with the banks and the test case??

 

is what they are saying about the courts right? and when i take them to court if they reject my letter before action will it mean i have to wait until its all resolved anyway?

 

any help or advice would be greatly appreciated.

erm i am not sure if i am suffering financial hardship.

 

i think i am though. i am a student and won't have any money coming in what so ever until end of september. with the charge happening will mean i won't be able to afford my share of the rent on my house at uni

 

i dont know if that would mean i have financial hardship or not though.

yeah i have a student account with them.

 

the charges aren't that much. only £78, but still thats a lot ofr a student

It should be £76 but is not financial hardship case.

The limitation period now no longer applies to bank charges claims.

The bank cannot apply limitations arguments to a bank charges case going back to 27th July 2001 which was agreed at the start of the OFT test case.

Claim your bank charges back to 1st Jan 1995. You will have 6 years from the date of the final outcome of the test case and OFT decision on fairness to do so.

 

The regulations UTCCR 1999 states that the term shall not be binding on the consumer, however, it does not say that you can go back to 1995 or from where the regulations themselves were enacted. It actually leaves it for the domestic courts to make that decision and therefore, it will have to be part of the OFT test case issues on the additional litigation should the Banks' appeal be dismissed in the Constitutional Court.

i have a problem with natwest with no help from there behalf, i have/had £350 overdraft which i used 90% of and then became jobless, i stopped using the account for a while as was claiming JSA in cheques. i then got a letter regaurding a sum of near on £700 overdraft, with anger i phoned the bank to ask what was happening and so on, they then sent me a statment which i asked for and there was months of months of charges applyed with intrest on top, i got back on the phone to them to try and sort this out and found out that they wouldnt stop or freeze the charges till such time as i could pay, with house rent, and phone bills to pay i was lucky to have £10 to my name left, at this case i tryed to ignore the fact, which was silly i admitt, hoping they would realise i was on jsa and wasnt able to pay such a "rip off" back, i know that banks in some way not alowed to charge this much, or i might be wrong, and now its gone to debt collectors and i tryed repaying what i had left to my name, to them. then my house rent was raised i am unable to make payments, i have 2 days to do something about something i can not do. any help people
