lol, wat i got is a box with pile of a4 size sealy bags so each company (b-card, vanquis ect) got their own bag and letter from dca's goes into the route companys bag. easy to find, easy to cross reference files.

 

trouble is i need another box now lol :D

that their fault, all stuff i send is stored on media not paper, I'm at point now if where possible I just email, that way it not costing me the paper, ink, envelope and the stamp, besides it more fun to slag em off coz most send autoreply saying they got it (keep autoreply as proof they got it) so u not even gotta bother sending it recorded :)

OK guys. VAnquis are still sending statements with charges added each time even though my account is in dispute. Despite me sending a non compliance letter they say that they have complied blah blah blah - for a while i got a couple of calls and letters from impact to which i wrote to let them know that the account was in dispute.

 

I came home today with a message left on my answer machine, i googled the number only to find that it was first credit.

 

I know i shouldn't have phoned but as this was a new dca i couldn't help it, i was curious to see who had sold on a debt without letting me know.

 

Needless to say it was vanquis. I told First Credit that the account was very mcuh in dispute and as far as i was aware was still with vanquis as they had yet to satisfy my requests, i also said that i had no notification that they were handing over to anyone else.

 

They tried to push for more information and i just said that as far as i was concerned the only people i should be talking too was vanquis.

 

They said they would update the files and then we said goodbye.

 

So........what do i do now? I thought that if a debt was going to be sold on to a dca that vanquis or any creditor were under obligation to tell you this.......

 

what is my next move here.

let it run dude, usually DCA sends you letter on behalf of creditor. First Credit are a relatively easy do deal with. if you want to send FC an s10 request under the DCA pointing that Vanquis has KNOWINGLY passed/sold an account whilst in dispute and can be proven so.

Thank you for your response to my request under the Consumer Credit Act section 78 and my complaint lodged at the beginning of the year.

 

I am pleased to see that you confirm this as a true copy of the original executed, regulated credit agreement supplied to you by Vanquis.

this is 1 i sent to cabot about my vanquis account. they EVENTUALLY gave up and not heard a peep abount account in 2.5 years.

 

 

As you must realise this agreement does not conform to sections 60(1) and 61(1) of the Consumer credit Act and is therefore unenforceable under section 127(3) of the same act.

 

You had until 20th August 2007 to provide me with the true copy I requested in my letter dated 30th July 2007. After that date you entered into default of my request. Whilst the account is in dispute, you are not permitted to ask for any payment, nor am I obliged to offer any payment to you. Furthermore, whilst the dispute remains, you are not entitled to charge any interest on the account, make any further charges to the account or pass the account to anybody else. I would also like to note that as from the (12+2 working days + 30 calendar days) it becomes a criminal offence.

 

Please note you may also consider this letter a statutory notice under Section 10 of the Data Protection Act to cease processing any data in relation to this account with immediate effect. This means you must remove all information regarding this account from your own internal records and from my records with any credit reference agencies including any defaults. Should you refuse to comply, you must within 21 days provide me with a detailed breakdown of your reasoning behind continuing to process my data. It is not sufficient to simply state that you have a ‘legal right’, you must outline your reasoning in this matter and state upon which legislation this reasoning depends.

 

Should you fail to respond within 21 days, I will expect that this means you agree to remove all such data. I would also suggest that you consult a “qualified” solicitor to verify that you have NO legal rights to this debt. Should you continue to harass me until such time you provide an executed, regulated credit agreement that contains ALL of the prescribed terms embodied within the agreement that contains my signature that fully complies with the Consumer Credit Act 1974, you will leave me no alternative to instigate legal action against you

came down with a cold today so naff lol, but ty for asking :).

 

obviously u need to mod the letter but leave the whitty bit in coz it funny (bit about consulting a "qualified" solicitor)
