hi there

i hope you dont me asking, you seem really clued up on this. i had a loan for £7600 with alliance and leic they have offered my ppi back for £501 which is correct as i repaid the loan early after 3 months . i repaid it because i didnt need ppi and wasnt able to cancel it ,so i had to take another loan out which would be cheaper in long run as no ppi.

the loan is with alliance leicester just without the ppi. okay.. so i accept the ppi but wasnt the loan miss sold maybe? should i try and claim the full 3 months pay £247 per month? or should i try and claim the complete miss sold loan £7600 or just take the £501 in ppi claim.

hope it makes sense and not to confussing lol. seems they have admitted liabilty on the ppi but not took into consideration of me having to re-fiance as this loan was miss sold. any ideas or advice welcome .. thanks

No is the answer because if the loan had got PPi that was refund to you and active then the amount should have been put back to the amount you would have had without PPI. If you refinanced the loan then that was your choice(unless they said you had to take out a new loan without PPI since I would argue any difference in loan amount old without PPI and new loan without PPI is potentially something you might be able to negotiate with them).

IMO you should reclaim the PPI payments you have made on this loan and also demand the contractual interest plus statutory interest at 8% you haveto remember this lot A&L have already been fined by the FSA to tune of £7m please see this and if the dates match your loan then hit them big time for a refund.

hope this helps you on the road to reclaiming ;)

Bank charge successes:

Halifax - Full settlement incl interest.

HSBC - Settlement, goodwill no admission of liability about 75% of claim.

RBS - Settlement, goodwill no admission of liability about 70% of claim.

2 ongoing claims for bank charges with HSBC with more to come. (Supreme Court ruling could have upset these claims) They did

PPI Successes

PPI 4 settlements on 9 loans. FOS involvement on 7 added on the 8 % Statutory interest another 30% to both.

2 claims settled in full with LV without FOS involvement.

2 claims settled in full with HSBC without FOS involvement

PPI Claims ongoing with:

Cap one Now with the FOS

Barclays. Paid up today 24/04/10 cheque received for over £4,500 and in the bank.

LTSB still have to decide on this as their SAR production was abysmal. Papers data mixed up documents missing etc

1 Complaint not upheld by FOS they said it was ICO issue. Complaint upheld by ICO. See this..

Please do not PM me for advice as it may be sometime before I can respond.

Keep at them. Do not give way and do not accept all they tell you, they will delay and stall for as long as they can to prevent repaying you your mis-sold PPI.
