      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Can anyone advise me, as to if the sky contract and terms and conditions are subject to the CCA 1974 or indeed any other legislation.

 

I do not remember having seen any contract or terms and conditions, I have been a sky customer for many many years and I am having a problem with a disputed account.

 

All comments and advice will be gratefully received.:);)

if the sky contract is not covered by the cca, i take it defaults are recorded much the same as mobile phone contracts

 

is that correct

 

and sky would only have to serve a termination notice and not a default notice

CPR from what I believe is used when looking at putting a case together against somebody, but you unable to do so without the full information, in this case documents relating to the contract and T&C's.

 

CPR can be used and if Sky produce the documents within its reply to CPR, then the claimaint has no reason to take it any further.

 

For example, the claimant wants to bring a court case together to order Sky to stop chasing payment due to no contract, but how can you put that case together when you dont know if they have that contract or not, so you got to request it, thats when CPR is used??

 

Nothing has to be in motion to request under CPR

to be honest i could be wront postggj, its just the idea i have got after doing hours and hours of research in to CPR and its legislation, only cause I have CPR'ed cap one and there have failed in two occasions and am planning to take them to court now. sorry of topic

 

hopefully someone will pop by and confirm ethier eay !

you wouldn't neccessarly have a written contract with sky.

 

they do paperless contracts and abide by their terms and conditions when you activate the viewing card.

 

as posttgg says you would need to send a sar to see how you signed up

Your SAR won't give you your Terms & Conditions - these are dynamic and change often (you've already agreed they can do this), simply by paying them you've agreed to the terms - no need to 'sign' anything.

 

You need to get to the bottom of the original dispute and sort out the amounts. For the record, Sky refused to deal with me, and I had to take them to court. They settled 2 days before the case called.

Received the following from Wescot today after having sent them the "Do not acknowledge any debt to you or any company you claim to represent" and the" NO Doorstep Collection" visitors letter.

Did you pay Sky for your services? If so - there is no need for them to provide a contract (signed or otherwise), you will be deemed to have agreed to whatever their current terms are at the time your services started, and then any variation thereof subsequently.

 

Since you are asking the DCA to ask Sky whether you are/were a customer, Sky will confirm this, and collection resume. It might be helpful if you could exand on what the claim is actually about, as trying to reject their terms because you hadn't signed anything will ultimately fail.

My post #5, Wescot letter, Quote, ("When you signed the contract with our client,it was stated in your terms and conditions".)

I await the proof from Wescot that I actually signed a contract with their clients and was provided with terms and conditions.

 

I will update with any future further developments.

Afraid this is a 'form letter' - and from the monkey, not the organ grinder.

 

As I mentioned earlier - Sky will confirm and the process continues. Wescot could say anything 0 but the KEY issues is NOT their errors, but any Sky have made. So with respect, instead of looking for loopholes, attack the root problem - what was the issue?
