my OH keeps telling me to sit tight and ignore letters and calls but I feel I need to do something.

 

I had previously CCA'd a DCA who were working on behalf of a company, they said it wasnt up to them to provide the Agreement, sent back my £1 and closed the account, I heard nothing for over a year until I got you know who contacting me some weeks ago.

 

Now I got some great advice but conflicting, do I tell the DCA who has now purchased the debt that it is in dispute or do I just do a new prove it CCA to them ?

 

I know these people dont let up and the next thing on my mat will be a SD, mind you that would be funny, quite honestly if they want to get rid of all my debts for me then feel free, I own nothing of any value. We are even carbooting the rest of our stuff this week to pay the electric bill.

 

But it is having an impact on my health greatly.

 

I have never had a debt with the bank they are suggesting, i have an account but thats all happy and in credit. I did have something about 3/4 years ago with a company that went under this bank, so am assuming its this but I dont know for sure.

 

I have not received a properly delivered notice of assignment from the OC

thank you, does it make a difference that this debt has now been sold? does that cancel out the dispute if that makes sense?

No, once it's in dispute it stays that way until the dispute is resolved or the company close their files. If it's then sold on without resolution it still remains in dispute and should be reported to the relevant authorities such as TS and the OFT :)

the previous DCA closed its files then sent it back to the OC?

 

I found 2 letters saying the exact same thing

 

 

" your account has been closed from our files are returned to *****, please contact our client for a copy of the agreement'

 

i think that must have been their second response from my letter saying they were obligated to provide the information

Sending it back to the OC does not resolve the dispute ;)

do I still include this bit because its been sold?

 

Now I would respectfully suggest that this account is returned to the **original creditor/DCA** for resolution of these defaults and breaches, as **New DCA** cannot lawfully pursue any enforcement activities.
