Interest still being applied after been to Court

Hi,

 

I was reading somewhere that when you are taken to court for a debt, one of the good reasons to go to court is that at least interest is stopped.

 

Well ours hasn't.

 

We were taken to court by Northern Rock in Feb this year for a £30k loan that we took out with our mortgage (together mortgage) - unsecured loan. We took it out in Sept 2005 and just over 2 years later we went onto a dmp, and 8 mths after paying them on the dmp they took us to court.

 

The judge decided that the way CCCS had worked out the payments pro rata by payments made rather than by total debt wasn't fair to northern rock so they increased the payment to them, only by about £40 or so, which was fine, it just meant we paid less to our other creditors.

 

However, I didn't know that interest could be stopped. Were we supposed to ask the judge for that or is it supposed to be automatic?

 

We are still paying interest.

it will be mentioned specifically in the judgement paperwork

if it doesn't say int can be charged then it can't

Is that in the paperwork they sent us before we went to court? Coz after court we were not given anything.

so if you were not given a judgement why are you paying them?

 

you p'haps need to contact the court and get a copy of the judgement against you.
