Hi everyone,

Im new here and have been reading all the posts concerning lowell/red.

Earlier this year I started receiving phone calls and letters from them advising that I owe 459pounds for an outstanding debt to Capital One.

I took out the credit card in 2003 and by 2006 had got in a bit of a mess. They started threatening court action to recover the money.

During this time, I received a letter from Capital One advising that they would accept a certain amount of the total debt as settlement and this amount was duly paid.

Since then, I have heard nothing further from Capital One and assumed that was the last of it. I have stupidly shredded all evidence of the settlement etc when moving house.

Lowell are now asking for the outstanding amount that should have been owed had I not taken the settlement. I have called Capital One who refuse to talk to me as they say the debt has now been sold on.

I am now at a loss as to what to do as the account was never paid in full, just 'settled'.

I do not want to pay Lowell anything but understand that they are able to put a default on my credit rating which will go against any future borrowing.

Any help or advise would be most welcome.

Send Lowells this; http://www.consumerforums.com/resources/templates-library/86-debt-collectors/573-general-debt-letter-if-you-know-nothing-of-the-debt the onus is on them to prove a debt exists,

 

You may have to send a SAR to CAP1 to get a copy of the settlement letter, but let's see what turns up with the above letter first.

I have sent a letter to lowell asking them to stop contacting me by phone as I am disputing the claim with Capital one. However, this has proven difficult as Capital one have refused to discuss it with me.

Lowell have disregarded the letter I sent them and have now taken to texting my mobile phone. I am pay as you go, which is not registered and have changed my number since my original account with Capital one, so I don't know how the even have my number.

Unfortunately, I cannot remember how I paid the settlement. I know it was over the telephone but I have asked my bank for previous statements but it is not on there

depending on what template is in the printer at time of response.
