Hi,

 

I'm paying a DCA £2.00 for month (approx 1.1k owing). The CCA they have is enforceable however, reading through this site, I have realised that the DN I was sent by the original cc company is invaild. What can I do about this? if anything at all. I'm reluctant to stop paying as this particular DCA will take you to court at the drop of a hat. Should I just suck it up and continue paying?

 

I'm think of writing and saying that I believe the DN is invalid just to hear what they have to say. Good or bad idea?

Hi Alex..is it possible that you can scan/photo the DN up on here (leave the dates on but delete all the personal details/reference numbers/exact amounts....did they send you a termination letter too ? it could possibly be an unlawful recission of contract...

Hi 42man,

 

Thanks for responding. I can't scan unfortunately, but i would be able to type in what the notice states, but not till later.

 

Bascially it states that payment should be made 14 days from the date of the letter which I understand is not correct?

 

I have no record of a termination letter, but I have an assignment letter from the DCA.

As a side issue- are there any charges or PPI on this account that you could reclaim to reduce the amount you may (or may not) owe?

 

We are very good at getting charges and interest on those charges removed- this could drastically reduce the amount you owe or even clear it completely.
