    • They can ask you to help them.   The reason for doing this is that the accident was between two private citizens with the Insurance companies covering the risk.  The Insurance company need your assistance to claim directly against the other driver, as the other drivers Insurance are not paying the claim.  Each Insurers pays 50% of the claim costs.     If you don't help the Insurers, I am not sure what they can do about this, as you are no longer a customer of theirs.   Perhaps ask whether they will cover your costs. e.g. time.

    • My former insurance company Axa, is taking the other party to court to reclaim their outlay  This will be in My name because legally the claim has to be in my name? Axa said it was 50/50 claim, so Axa paid me out.   Can this be done in my name without my permission? Axa said it was 50/50 why are Axa going after the other driver? i thought Axa would pay me, the other party paid by their insurance company?

This would not have an impact on your credit file because the FCA set provisions for this due to COVID19.  Furloughed due to COVID is a valid reason for a payment holiday. In this case I believe they have failed you and this is not taking into account my own experience of dealing with them.    Do you have copies of the I&E thats you filled in on both occasions? If so can you post them up minus personal details.  Note that this loan is **NOT** considered High Cost Short Term Credit because of the Loan Period of a year. (HCSTC for short)    There is no requirement for Bank Statements to be sent to them and insistence on that being the case is bordering excessive. The only requirement is that you give them an honest I+E. Even then you have already done that. My personal thought is that either you or they have butchered the I+E - I think its them because the staff trip people up on the phone constantly.   Unfortunately they are a company that does do Court Claims themselves. As long as you have been honest and theres no issues with the I&E - They wont succeed in court.  So let me know how you want to draft your complaint - Paste a copy here and ill go through it with you before issuing it to them.

      I was in Sainsbury’s today and did scan and shop.
      I arrived in after a busy day at work and immediately got distracted by the clothes.
       
      I put a few things in my trolley and then did a shop.
      I paid and was about to get into my car when the security guard stopped me and asked me to come back in.
       
      I did and they took me upstairs.
      I was mortified and said I forgot to scan the clothes and a conditioner, 5 items.
      I know its unacceptable but I was distracted and Initially hadn’t really planned to use scan and shop.
       
      No excuse.
      I offered to pay for the goods but the manager said it was too late.
      He looked at the CCTV and because I didn’t try to scan the items he was phoning the police.
       
      The cost of the items was about £40.
      I was crying at this point and told them I was a nurse, just coming from work and I could get struck off.
       
      They rang the police anyway and they came and issued me with a community resolution notice, which goes off my record in a year.
      I feel terrible. I have to declare this to my employer and NMC.
       
      They kept me in a room on my own with 4 staff and have banned me from all stores.
      The police said if I didn’t do the community order I would go to court and they would refer me to the PPS.
       
      I’m so stressed,
      can u appeal this or should I just accept it?

Hi

I have a loan out with Wonga. Have been indebted for a while. Get a loan pay it back get another loan. Last month I had no money to pay back and did not want to extend as I could not afford to. Now I am receiving emails form them and have been emailing back. I request that they phone me to discuss repayments. They asked for my number which they already have as it end the pin number.

But still no call and interest is accum every day is this normal from them.

Has Any one been taken to court or fought the pay day loan company's after seeing loan sharks recently brought to court is there really a difference

It will be a long time before they take you to court, purely for the reason the courts hate them and do not agree with their business. I used to email them, no matter what you say in the email. they will always say call us, this is because they have their set script of what to say to people to get their money back so avoid calling them. They do not respond to letters. Wonga have their own solicitors to threaten you with also. It will be a very bumpy ride, you might want to consider a DMP with CCCS to pay them back but the interest will rip up any attempt to pay it back so complain to trading standards and see if they will freeze it.

I have been to Court on several occassions and have taken some time to look into how it works and how judges make decisions. There is no such thing as an unfair price in UK law so there is no defence that the credit is expensive. Even try to argue and unfair relationshipo would be defended with an argument that they were transparent and you knew the terms when borrowing. There are CAG posters who have been to Court for payday loans and none seem to have won their case on the basis that the credit was expensive. I would always give them a ring at least once to see how they handle your situation. If they are bullish then you can always email them again. Not talking to them is when it becomes more expensive and stressful. My advice is try them again on your terms and fight until you get the right repayment arrangement for your circumstances. How have you found Wonga so far?

Not the orgininal poster but I found Wonga extremely hard to deal with/talk to. I only spoke once of the phone, they are pushy, harrass and make you feel awful. They will read their script to try reduce you to tears to make you pay but if you have'nt got the money, you have'nt. Give them a call, explain and as soon as they get rude/pressure you, hang up, Don't listen to them. if you Have to, talk over them and explain again and again. Wonga won't listen, so email them, they will then send you emails back saying ring us. I complained to trading standards in order for them to stop my interest going up.

Well said. I would love to see a payday company explain their interest rates and their penalty charges. I begged Wonga to take me to court but they would'nt, just sent me letters at £50 a piece.

Can't say I'd click on any links like that anyways. Not the best place to advertise loans etc as we all want advice/revenge against brokers/collectors/loan companies.

 

Does anyone know if there is any sort of campaign against this type of loan?

Post 3 - yet more spam. Do they really believe having arrived here anybody is going to go there again??

 

Camuser - keep going with the emails, offer them what you can reasonably afford. There are a number of us here with their bank details if you want to start repayment to them in the interim and one cagger who started me on my way even has the contact details for their CEO! A well placed pm or two will get you these details if needed ;)

 

They will not make it at all easy and there are one or two horror stories here about their excesses but with persistance you should be able to move them to a repayment plan. Any references I have seen on here relating to progress to court action have been limited and to my knowledge none of them have either got into court or been awarded against the debtor once there (I might be wrong?). More usually they are either discontinuing before arriving there or hoping to proceed to default judgement if the debtor does not defend.

I have emailed Wonga now for a couple of days. Several emails a day for them to contact me for a sensible and fair repayment plan.

I checked the account online and it frightens me the amount that has accumulated these last few weeks. This surly cannot be fair. As I had a couple of loans and bad credit history, they are clearly unreasonable lenders. Can anyone point me in right direction to an organisation to complain?

As far as my argument goes I took a loan for 30 days. Things went wrong from my point of view but the interest after the 30 days should be at the rate you would claim through small claims court 8% I think.

i have pointed out in my emails the stress that this has put me under and as a customer care LOL email address why is there no contact???:evil:

Hi camuser, Having dealt with Wonga by email. I can assure you they will not reply, they will ask you to ring them. Do not ring, they will try and pressure you into paying, Do not ever pay more then you can afford. Do not give card details because they will try to take larger amounts of money from you. I contacted my local trading standards and got the interest put on hold. I went through a Debt Relief Order in order to get my debts under control.
