HSBC CCA Request - Loan & CC

Hello everyone,

I've been looking into my OH's HSBC account to see if everything is in order as it should be.

We have been severly stung with excessive bank charges and am really hoping that the test case brings positive news for us.

Anyway.... some time ago, i sent off a full SAR and all they sent back were statements, but not for all accounts.

I have complained and stated that i require copies of ALL information.

 

I have also sent a CCA request for a loan agreement and for a Credit Card agreement.

OH actually went into the bank to set both of these up, this was in January 2007.

Below is what they sent.

Comments on enforcability are very much appreciated.

cca from 2007 are not 'automatically' unenforceable like ones pre 2007

hello, thanks for looking in, can you explain what you mean by automatically unenforcable pre 2007 ?

if you had an agreement pre 2007 and therewas a prescribed term missing i.e. interst rate etc then you can argue unenofrceable becasue of this but since 2007 it is up to the judge.

 

 

but to be honest the loan you posted has the prescirbed terms anyway

thanks ida, what about the cca for the credit card ? this was january 2007? if this makes a difference ??

cc has the prescribed terms although it looks on seperate pages but as this was 2007 then the above rules apply,

 

are these seperate pages? did you do this online and print this pff and send back to te bank?

from what my other half tells me, he went into the branch to arrange both the loan and cc, and they printed the docs off there and then.

it looks as tho done online in the bank and printed out at the time.
