    • I came across this discussion recently and just wanted to give my experience of A Shade Greener that may help others regarding their boiler finance agreement.

We had a 10yr  finance contract for a boiler fitted July 2015.

After a summer of discontent with ASG I discovered that if you have paid HALF the agreement or more you can legally return the boiler to them at no cost to yourself. I've just returned mine the feeling is liberating.

It all started mid summer during lockdown when they refused to service our boiler because we didn't have a loft ladder or flooring installed despite the fact AS installed the boiler. and had previosuly serviced it without issue for 4yrs. After consulting with an independent installer I was informed that if this was the case then ASG had breached building regulations,  this was duly reported to Gas Safe to investigate and even then ASG refused to accept blame and repeatedly said it was my problem. Anyway Gas Safe found them in breach of building regs and a compromise was reached.

A month later and ASG attended to service our boiler but in the process left the boiler unusuable as it kept losing pressure not to mention they had damaged the filling loop in the process which they said was my responsibilty not theres and would charge me to repair, so generous of them! Soon after reporting the fault I got a letter stating it was time we arranged a powerflush on our heating system which they make you do after 5 years even though there's nothing in the contract that states this. Coincidence?

After a few heated exchanges with ASG (pardon the pun) I decided to pull the plug and cancel our agreement.

The boiler was removed and replaced by a reputable installer,  and the old boiler was returned to ASG thus ending our contract with them. What's mad is I saved in excess of £1000 in the long run and got a new boiler with a brand new 12yr warranty.

You only have to look at TrustPilot to get an idea of what this company is like.

    • Dazza a few months ago I discovered a good friend of mine who had ten debts with cards and catalogues which he was slavishly paying off at detriment to his own family quality of life, and I mean hardship, not just absence of second holidays or flat screen TV's.

I wrote to all his creditors asking for supporting documents and not one could provide any material that would allow them to enforce the debt.

As a result he stopped paying and they have been unable to do anything, one even admitted it was unenforceable.

If circumstances have got to the point where you are finding it unmanageable you must ask yourself why you feel the need to pay.  I guarantee you that these companies have built bad debt into their business model and no one over there is losing any sleep over your debt to them!  They will see you as a victim and cash cow and they will be reluctant to discuss final offers, only ways to keep you paying with threats of court action or seizing your assets if you have any.

They are not your friends and you owe them no loyalty or moral duty, that must remain only for yourself and your family.

If it was me I would send them all a CCA request.   I would bet that not one will provide the correct response and you can quite legally stop paying them until such time as they do provide a response.   Even when they do you should check back here as they mostly send dodgy photo copies or generic rubbish that has no connection with your supposed debt.

The money you are paying them should, as far as you are able, be put to a savings account for yourself and as a means of paying of one of these fleecers should they ever manage to get to to the point of a successful court judgement.  After six years they will not be able to start court action and that money will then become yours.

They will of course pursue you for the funds and pass your file around various departments of their business and out to third parties.

Your response is that you should treat it as a hobby.  I have numerous files of correspondence each faithfully organised showing the various letters from different DCA;s , solicitors etc with a mix of threats, inducements and offers.   It is like my stamp collection and I show it to anyone who is interested!

I have both patience and time. In fact time is all I have, Lot`s of it.

I don`t work, I`m disabled. The greatest thing tough is I now have some thing to concentrate on. Welscum Finance. I have so much time. I spend every waking minute reading on CAG about these ****. I am dedicated to there complete and utter ruin.

Pointed in the right direction by people on CAG. I have then researched every piece of Consumer Law and Regulations I can find from anywhere. They don`t frighten me. I was on HMS Ardent in `82 when she was hit. I was in the first Gulf War. I`ve faced worse than these bunch of ankers.

I concentrate my mind by thinking there all Argentinian Pilots who work at Welscum now.

Enloyed that!!!

Cheers, MARK

Hi Mark, nice to see you are still around watching and waiting.. Like me mate, keep it up, your views and comments are well valued.

I got into this mess with a big secured loan by trying to keep my house when my wife left me with my young son on my own. Of course at the time I had a car loan and a small loan with Welcome and they were more than happy to be invoved with securing a loan on my property to help me out but of course did not explain the consequences and all the time I just thought they were looking after me while I tried to keep a roof over mine and my sons head !!!! I know that sounds nieve but throw in the sudden death of my dear mother and a counter claim of property from my ex partner and here we are. Who can think clearly under those circumstances...I feel a fool to say the least !!

Dont feel a fool pwg unfortunately for people like us welscum or any other company for that matter dont give a sh*t about circumstances, no i take that back, they do but only to use it as a means of more £ for them! Unfortunately for them although circumstances push us towards them that doesnt mean we are stupid and will be eternally taken for a ride :D

I dont suppose it matters whether they know or not other than it making them worry you have more knowledge than first thought and set them into abit of a stress lol Maybe they should take more time to do their jobs properly and less time reading these threads and then there wouldnt be so many threads to read :p

Hey pwg!!! We can`t let them get us down. They are lower than pigswill level. Don`t ever forget you are better than any of the **** who whore themselves out to these BA***ARDS. Everybody who works for them knows the score M8. They don`t care at all what anyones situation is, only their own.

The knowledge we are armed with now pwg is enough to make them think about what they are doing. Collectively, we CAGGERS will blow them out of the water.

We all face things we didn`t ever want. And of course we reach out to the helping hand. That`s when the Snakes see us coming. They see need and they thrive on it. Our time is coming though!!! So I say F**k `EM! F**k `EM ALL!!! What do YOU SAY??? LOL

Cheers, MARK:D:p:rolleyes:

Hey, pwg6565. I received that same letter from FOS back in July and then was told in October that I'd have an adjudicator early December. Well, happened quicker than they said. Adjudicator was assigned 17 November and he sent me an offer 25 November.

Only I'm still not happy and have been advised here and on another forum to ask for another adjudicator.

So, hopefully yours is dealt with quickly and you get a good outcome! All the best :)

I'd just sit it out for the 8 weeks PWG, see what they come back with first, and then play hard-ball!! imho, there may be others who can advise you better than me!!

As for the cra, secured loan/mortgage...I have the same issue, I complained to the cra, and have their response, welcome will ammend it...still waiting, i did actually also get off welcome in black and white some months back, after writing a formal complaint to them, they have admitted, that they are not mortgages, but are indeed secured loans....strengthens my case though ..dont you think?

Hi Brassed, how you doing ? Any news with your dealings ?

I have decided to sit and wait and see what Welcome come back with. It would just be nice to know what the problems are with my contract as Postggj said it is worthless on its own regardless of all of my complaints. I had two phone calls from the local branch earlier but ignored them. Cannot believe they keep ringing when it comes around to payment time of the month. They really do have thick skin !!!!

Had another two voicemail messages from the local branch today. Can I call them urgently to discuss my account !! Why do they persist in these monthly calls when they are aware that they are not supposed to be calling ?? Needless to say I shall not be calling them back !!

Love it......Merry Christmas all caggers !!!

Thanks ozzy. I had two messages left mid Dec asking me to ring the local branch urgently but I did not call back and have no intention of doing so. It is in the hands of the F.O.S. now and any calls they make to me are logged by me and will be added to my complaints as I have requested all communication in writing. They must be aware I am on to them as no home visit and no court threats. As Postggj said they must know I know my contract is rubbish.

Just spoke to my local branch----not a mention of all of the goings on!!!

Just collected my money as usual----so I would say at grass roots level nothing has changed as yet, we wait with baited breath.

Happy New Year

Beau

Please note: I am not a lawyer and as such any advice I give is purely from a laymans point of view;-)
