hiya all,

 

i have just got back from my hearing on a gross misconduct case. i lost, got the sack.

 

now there are saying that i got sacked for using threatening behavior ie i swore at somebody twice but there are saying in a aggresive manner.

 

what next should i appeal i think so.............

You can appeal the decision, what will your grounds be.

Just a quick question is this new thread related to your other one regarding Gross Misconduct, if so you could also ask in that thread.

Normally, you will get given written confirmation of the decision plus a copy of the interview notes allowing 14 days to appeal the decision. Did they provide you with a copy of the evidence prior to today's meeting?

Have they complied fully with their own disciplinary procedures which you should have a copy of?

yep there done everything by the book, even the person who did the hearing a few years agao i thought what a arse but now i see him as ok.

 

the grounds i have for a appeal is that i want to challenge the gross misconduct case.i used 2 swear words at a colleague at work but there are saying i used it in a threatening manner.

Did you ask in your case for mitigating circumstances to be taken into account, ie service to the company, etc,etc,?

Have you made plans for both eventualities, best case scenario and worst case scenario?

well i have lost the job so the best case would be to get my job back.

 

but the main thing i will going there for is to get this gross misconduct file dropped to something like dismissal.......because gross can bugger u up for jobs in the furture....

No it doesn't. I was sacked for gross misconduct from a bank for leaking confidential information to a third party. The big issue in your mind is how to explain being dismissed. Remember on application forms you put down "Dismissal"...I have never ever written GROSS MISCONDUCT as a reason for me leaving the job. I worked in banking for 11 years so I couldn't leave it off my CV either. It is the way you explain is the way you deal with it. Do not appeal simply because it was Gross Misconduct. Appeal because it was a one off flippant remark caused by not sleeping well, if you want to find something to say, and was out of character for you in your years of service to the company

 

EDIT: and you feel that a formal written warning is more appropriate.

I got the sack for gross misconduct a few years ago - I can tell you now it is hard work to get another job - once you tell people they just don't want to know.

 

I have been working for 30 years and nobody takes any notice of your history only the fact that you got the sack.

 

It seems a bit harsh to sack you for gross misconduct are you sure its not something else?

nope they said it was threatening behavior which is wasnt,but they said it was the way it was said.bollocks(sorry).

 

so did u get another job,what did u put on the application form and how long did it take you to find another job?

It took months and loads of interviews - been 4 and half years now. most employers want 5 year history so almost up . I was always honest but to no avail -I could just see there face drop when I told them - I have had to work on a much lower income for last few years. My problem was I didnt get on with one of the managers/directors so card was marked as they say. suddenly I was the worlds worst worker but I had been ok for the past 4 years!! ******s.

All sorts really - they had a long list that they had collected over 6 months or so just to make sure. nothing worse than any one else was doing.

Kissit, you have got to remember that you were dismissed but as to the circumstances that is your version and give it a positive spin in your circumstances, "a moment of madness" which you regret and have learnt from. Great company to work for and disappointed by your own actions, etc,etc, Remember, no outstanding issues remaining line is very very effective when you say dismissal.

Most employers simply give the reference(or refuse to give a reference) with the words started on x date and was dismissed on y date.

ok yourbank i think i am geting my head around it all. have you ever told anybody when u go for interviews that u got sack for gross misconduct(then explained why u did) or just say dismissed...........

kissit2005 - sorry to hear about this - you could get round this by applying to an employment agency for some temporary work for a while. I don't really want to put too many details here, but I know what you are going through, been there, done it, got the t-shirt, and look at me now!

 

I went to an agency specialising in my field, they placed me, I was honest with the company and six months later they took me on. I relied on former colleagues and one of the biggest private landlords in this area (my mate fortunately) to give me references, and I've never looked back.

 

You feel useless right now and still very shocked, so everything will look black to you. If you can afford to do it, take a few weeks to get over the shock, then get yourself out there to an agency and I reckon everything will be fine. You will also find out for sure who your friends really are.

hia, jackiieawayne. at the moment i amworking for my local NHS which was my evening job b4 all this happened,which now aegone long ad they have given me loads of overtimead hve be really good to me,but i know overtime will never allways bethere.

i wasthinking last nite aout going down the agency route myslf which i will hve alook at in the near furture.

Fingers crossed for you, really, I do understand, and I know it makes you feel wretched and worthless. At least you have some work to keep your mind occupied. I always like to think everything happens for good reason, I'm certainly in a much better position that I was 5 years ago when I had to go through all this crap. Happier, healthier, wealthier, although i admit I am having a set to with my employers currently. But this time I know I am in the right and that keeps you going. I'm very jammy, already have a firm offer of another position if I want it with another company, they are aware of the latest load of to do, and are happy to wait for me! Everything will be fine, I promise, just make sure you hang on to your pride.

hiya, i have to say that when i was on suspended pay for the week i was really worried,couldnt sleep,eat etc but when i got the sack it was like a huge weight was lifted off my shoulder.

 

yes the NHS have been brillant to me and hopefully something will come along and i will look back and think why the hell did i stay there for all those years.

You will in time and when you start looking for work you will realise how many opportunities you might have missed because of being in your comfort zone at work.

Things do get better so stay positive because there will be taught times but once you get that new job things do get better.
