I left a business partnership in 2004, three and half years later NatWest sent me a demand for monies. I orangised a sale of the business (my ex-partner who had taken over running the business had run up debts without my knowledge).

 

The sale was for £75,000 - there was money owed to the council for rent and solicitors fees as well as the Bank.

 

The balance on the current account when I left (the bank knew I had left the partnership) and the balance on the loan account WOULD have been cleared by the sale along with the other debts.

 

My ex-partner's balance on the current account (the bank had increase his overdraft, again with no reference to me) and the balance on the loan account WOULD NOT have been cleared by the sale along with the other debts.

 

The Bank refused to release it's charge for the sale to go ahead, the lease was forfeited by the council and the Bank have since pursued me for the total amount owed. The council went on to lease the business to the prospective buyers.

 

I have no monies and have been left in great personal debt by my ex-partner. I am having to represent myself at court.

 

My question is was it legal for the Bank to refuse the sale when my debt would have been cleared by the sale and it is me they are pursuing?

Hi Kirsty, welcome to CAG.

 

I think the bank were stupid to block the sale, but I have learned over the years that banks are pretty stupid all-in-all when things "go wrong" if you take a step back and look objectively at them.

 

I can't directly answer your question, but someone will be along to offer some more advice soon I am sure.
