      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi,

Im still getting to grips with all this. So firstly if Ive started this thread in the wrong place - apologies!!!!

 

Im currently going through all my partners debts etc. He has a debt with Lloyds - he believes its from an old business loan but has lost the paperwork. The loan/debt must be from at least 5/6 years ago when he was self-employed. To cut a long story story short he got into financial difficulty and the debt was taken on by Wescot. He currently pays £40 a month by DDM to Wescot.

 

He want to go through the CCA route etc with this and hopefully get the debt written off. But I need some help....!

His last correspondence (dated 22.05.2009) was from Lloyds TSB (Bristol address). And attached a "Concessionary Arrangement Statement" yet then goes on to say "Your accounts is/are being managed by Wescot Credit Service Ltd". Do we sent the CCA request to Wescot or Lloyds? He does get regular letters from Wescot offering him 25% off he he pays the whole lots off as a settlement offer.

 

Any help/advice would really be appreciated as he's struggling to pay the £40pm DDM........

ok well don't fall into the trap proported by claims co's that your debt will be magically written off if the CCA proves unenforcable - it wont!

 

A CCA that returns as being unenforcable or non existant is not some magic bullet that wipes debt out, all it does is makes the debt unenforcable in a court of law. and the debt remains that way till an enforcable CCA appears.

 

Now what it does do for you is put you in a very strong position, esp in respect of a DCA that has BROUGHT the debt [as apposed to just collecting on it for the OC,] to make a very low F&F offer to close the matter once and for all.

 

actually i'm really suprise WC has not forced a higher repayment over this time, they are usually one of the most unfriendly ones to deal with

 

now , back to you question............

 

you need to find out if wessy are collecting or have brought the debt

you should have recieved letter from bank & wessy that told you they were buying the debt did you?

 

i bet if you CCA wessy they will say you will have to wait for them to get it from the OC

it matters not as the 12+2 working day limit still stands regardless

I will send the CCA to Wescot and see what happens. In respect to them not asking for more money. There is a letter from Wescot (dated 02.04.2008 ) which states amount of debt £4976.42. Frequency of payment monthly. Amount each payment £40. Final repayment month October 2018.....So not sure they could ask to increase it as they have stated that??

Thing is I wish OH did have the original paperwork as he's convinced there was PPI on it too that he was told he had to take out.......

Thats the other odd thing with this debt. We did get copies of his credit files a couple of months back. There is nothing listed anywhere in relation to this debt?!? The only thing we could think of is as it would been a business loan maybe it didnt show for that reason.....or are we wrong?? :-?

 

Im going through all his files tonight and its a nitemare! Off to start a HFC thread.....as thats another mess!

yep i was wondering about charges & PPI

 

might be an idea to follow the sticky on the ppi forum and send an sar to the OC rather that CCA wescot?

 

you can always [if it is not already done] include a line that you want the CCA in the SAR returns package

 

OK it cost £10 as apposed to£1 & it will be 40 days rathe than 14, but ithink its worth it!

thats only a list of reported debts

it is not comprehensive

it might not show at all for early A/C

then again it might be on one of the other two cra sites

I had an account with HBOS for years, that never showed on my report until I defaulted.

Update - due to one thing & another we didnt get to sort this debt & SAR out for a few months.

 

Anyway we sent SAR off to Lloyds TSB.

Have had a letter back today saying to enclose a cheque for £10 (which we have already done?!?) also

"I see that we do not hold an up to date signature for you. For your security we will require a copy of either your passport or driving licence, certified by a lloyds tsb branch for id purposes. Or alternatively once we have collected the info you can collect the parcel from a lloyds branch and show ID then.

Am I right in saying they dont need ID etc or for a quiet life do I just do what they say???

They have also enclosed a form we have to complete in order to get the info....

Just another update on this -

Completed the form they sent basicially just asking for copies of everything (as Id already requested on SAR). Also said they dont need copies of my ID....hope I was right with that.

 

Have heard nothing back. No acknowledgement, chq not cashed and no info.....

Update -

Recieved all the info from them yesterday. Im saying all the info but havent gone through it all yet. Theres tons so will take me a good few days/week to work through it, they also sent a cd with phone calls on. Will update again once Ive been through it all!
