    • Well tbh that’s good news and something she can find out for herself.  She has no intention of peace.  I’m going to ask the thread stays open a little longer.   It seems she had not learned that I am just not the one!!!!  plus I have received new medical info from my vet today.   To remain within agreement, I need to generally ask for advice re:  If new medical information for the pup became apparent now - post agreement signing, that added proof a second genetic disease (tested for in those initial tests in the first case but relayed incorrectly to me then ), does it give me grounds for asking a court to unseal the deed so I can pursue this new info….. if she persists in being a pain ? If generally speaking, a first case was a cardiac issue that can be argued as both genetic and congenital until a genetic test is done and then a second absolute genetic only disease was then discovered, is that deemed a new case or grounds for unsealing? Make sense ?   This disease is only ever genetic!!!!   Rather more damning and indisputable proof of genetic disease breeding with no screening yk prevent.   The vet report showing this was uploaded in the original N1 pack.   Somehow rekeyed as normal when I was called with the results.   A vet visit today shows they were not normal and every symptom he has had reported in all reports uploaded from day one are related to the disease.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hello everyone. My name is Aaron and i am new to this site.

 

As a few people might of done on this site i purchased a car on finance last year and simple can no longer afford it . ( along with insurance,running,tax and repairs. )

 

I rang the finance company and they were ogres. " no sorry cant help you if you had a shorter term than 5 years we could extend it to make it cheaper as you dont we cant help".

 

Hold on 5 years!!! When i took the agreement i asked for it to be on 3 years whats going on?.

 

I decided enough was enough with companys taking me for granted so for once in my life i took this very seriously and decided to go through my agreement with a fine comb.

 

On the agreement it stated 60 months i couldnt believe it. Before anyone says its your fault you should of checked i sat in car craft for 5 hours waiting to be accepted with 2 screaming kids who needed feeding the last thing i needed was to spend anther hour or two looking through the agreement. I have learnt my lesson. I THINK THE WAITING PART IS PART OF THERE SALES TECHNIQUE.

 

Anyway i also noticed the agreement said £450 deposit paid, hold on i only paid £100 did carcraft fiddle it so the finance company would accept me??

 

Also the cash price of the car is £7499 on my carcraft invoice yet £7999 is the amount i borrowed from the finance company excluding interest.

 

Also i have two different interest rates on the agreement.

 

Also the figures on the agreement do not add up at all it looks like a 3 year kid did the maths.

 

Now apart from this i was lied to by car craft saying i had to have warranty for the finance to accept me. After calling the finance company they assured me i didnt so after alot of aggro i cancelled it. I have heard alot of bad things regarding carcraft even the finance company im with stated " We no longer deal with carcraft due to reasons i cannot discuss"

 

any help would be appreciated as im in enough debt without spending money after money on running costs and the car.

 

Is my agreement unenforcable???

 

Do i stand a chance in court??

With what i explained does it sound like i may have a chance cancelling.

Was there any PPI on their? When you paid for warranty it usually is added on top of the total amount paid for the car, so for instance 3 years warranty cover = £800, that is then added onto the total price of the car, ie. Car£7499

Warranty £800

=£8300

 

Does that sound familiar? Or did you have a yearly/monthly rolling warranty?

Yes remove any Identifying details, names addresses, reference numbers, any bar codes, bank details definitely.

No one mentioned court i just didnt want to take it to court if i dont stand a chance and the warranty was removed last year and on a new statement still had cash price differences so its not the warranty that makes a difference.

Yeah i know i certainly will never do it again i feel so stupid not reading the agreement but hey you learn from your mistakes . Gonna get the agreement on here tommorow so people can check it for me . Im just praying there is a problem with it. By what ive seen i certainly think theres more than one prob.

Ok i have scanned the images . the first two are my invoice and terms and conditions of the invoice. The rest in order is my credit agreement. I have scanned them in order and the last one is a statement which is after i cancelled my warranty and the figures still dont make sense

 

The invoice has deposit paid £100

The agreement states advanced payment £200

The statement states £450 paid.

 

Also figures are wrong on cash price.

 

Ill scan the statement aswell.

 

There are pages about pinnacle insurance aswell which i didnt ask for so im not to sure what its regarding.

Yeah links are working fine, but you need to go back and remove your name, I would also remove the make and model and the chassis number. It may take a while,

so remove the link to the scans, make the changes and then post them back up on here.

 

Sorry if it seems a pain, but it's for your safety, as employees of the garage or the finance company can easily identify you with those details:eek:
