My chum has a business account and the business ceased trading - not liquidated, but ceased trading due to ill health leading to no cashflow and business stopped as well as income. She's now on pension credits. Bank have directors guarantee for c30k and chasing.

 

Local manager can arrange repayments on an interest only basis otherwise it will have to go to Telford as they cannot reduce or arrange any reduction to the capital balance for a full and final (which she can't afford anyway) at a local level.

 

My thought is not to get interest only because it will come back to haunt her later anyway, but to 1st try and negotiate a freezing of interest and make payments on the capital. - That can't be arranged other than in Telford, trouble is Telford might go for her.

 

Has anyone any experience of how negotiable Telford might be on say a reduced balance which is affordable plus a reduced interest rate or any other kind of deal you think they might accept. Or are they ruthless? In which case the first option of keeping it local might buy time, but my fear is that's only putting off the inevitable.

 

Some monthly payments can be made, but not much as the situation is just now.

Hi andrew1.

 

Has your friend thought about contesting the validity of the DG? I'm not suggesting she should evade her responsibility to pay back what she owes, merely that a dodgy DG may put her in a bargaining position and enable her to buy time.;)

 

Here's a thread with similar problems. Don't know how it panned out as OP went quiet in March. He might respond to a post on his thread, though.
