Hi everyone,

 

Over a year ago OH sent a CCA request to NatWest and their reply was that they didn't have any paperwork so admitted they couldn't, legally, enforce anything.

 

Suddenly, this week, OH gets a letter from them saying they incorrectly advised the status of the account. That because "the account was opened in 1984 and S.78 was brought into force in 1985, under regulation 9 of the Copy Documents regulations, it is sufficient to supply a copy of the current terms and that acts as a 'true copy'". They therefore want OH to pay up!!

 

Anyone out there know if this is right?

they should have asked you to sign a new agreement in 1985:
