I have been logging in to this site for quite some time now due to various DCA letters I had received from companies such as the above plus Scotcall, Private and Commercial and a couple of others. My problem now is that I have today received a letter from Nelson Guest and Partners on behalf of Wescot Credit Services Ltd demanding payment of £1,063.52 within 7 days for a Barclaycard from years AGO.

I have been on a payment directly with Barclaycard for £1 per month with frozen interest and have been for approximately 2 years, Barclaycard have never once said that they require me to pay more money and it is set up as a direct debit every month so are these cretinswithin the law to chase me for a debt that is already gradually being cleared. Any advice would be greatfully received as it is now becoming a stress to me that all of these companies seem to be coming out of the woodwork at the same time and as I only work for the NHS I have absolutely the minimum amount left from my wages every month. I have no legal training and the advice I offer is a matter of support. Before you commit to any Legal action you are advised to contact a qualified legal practitioner.

Bank charge successes:

Halifax - Full settlement incl interest.

HSBC - Settlement, goodwill no admission of liability about 75% of claim.

RBS - Settlement, goodwill no admission of liability about 70% of claim.

2 ongoing claims for bank charges with HSBC with more to come. (Supreme Court ruling could have upset these claims) They did :mad:

PPI Successes

PPI 4 settlements on 9 loans. FOS involvement on 7 added on the 8 % Statutory interest another 30% to both.

2 claims settled in full with LV without FOS involvement.

2 claims settled in full with HSBC without FOS involvement

 

PPI Claims ongoing with:

Cap one Now with the FOS

Barclays. Paid up today 24/04/10 cheque received for over £4,500 and in the bank.

LTSB still have to decide on this as their SAR production was abysmal. Papers data mixed up documents missing etc

 

1 Complaint not upheld by FOS they said it was ICO issue. Complaint upheld by ICO. See this..

Keep at them. Do not give way and do not accept all they tell you, they will delay and stall for as long as they can to prevent repaying you your mis-sold PPI.

OK welcome to CAG, and you will find some very helpful people on here, so try not to worry too much:)

 

Some questions firstly,

Is the debt with barclays for a credit card (CC)?

A loan, a bank account?

 

Did Barclaycard send you a notice of assignement (NOA) saying that Westcot were now the authorised agency to collect their money?

 

Did Westcot ever send you a letter saying that they were now the owners of the debt, or were acting on behalf of 'their client'?

 

Have you spoken with Barclays at all regarding this??

 

I don't normaly condone ringing them unless you are able to record your calls, but it will be a quick simple answer, and if they have sold it on without your knowledge then you can cancel you Direct debit with them.

 

As a matter of course, it is strongly advised that you don't have a DD set up with them as they can take any amount they wish at any time, if you can you should only set up a standing order, which is something you can control.

 

And as for them demanding that amount to be paid within seven days, it is against the OFT debt collection guidelines, not that they care, so you shouldn't concern yourself about that drivel..

Try not to worry about their threats, that is simply all they are, yes they can send people round to your address (unlikely) but they have no more right to be stood on your property knocking your door than I do!

 

As for any threat of taking you to court, that is the very last place they want to take you, a)it costs them money b)they invariabley don't have the correct paperwork....

 

Along with their threats of adding charges, to inflate the total amount, this again is unlawful, it just makes them feel big, I guarantee you will have the upper hand on them, and you will be back in control of them, so try not to worry..:D

Who ever heard of someone getting a job at the Jobcentre? The unemployed are sent there as penance for their sins, not to help them find work!
