Yesturday i got back to my car and found a PCN even though i had a valid ticket!

 

I have kept hold of the ticket and obviously the PCN, is having the ticket enough proof that i had paid?

 

Should i challenge it or just pay the fine?

If you were displaying the ticket I would copy the ticket & PCN & challenge. Do not send the original.

 

Do remember though that failure to display will be as bad as not having a ticket in the 1st place.

As per mkb above, pay and display carries two conditions, so paying and not displaying is a contravention. However I disagree that it is "as bad" as not paying at all. Legally yes, but in the context of an appeal, no.

 

I would not advise you to pay at this stage. A photocopy of the ticket with a polite letter of appeal will give you a fair chance of having it cancelled.

 

If it wasn't on display, or was face down or something, the worst thing to do would be deny this and accuse the PA of being in the wrong, as they will look at their photos and see who's right. If you've said something incorrect about that you can expect your appeal to fail. Better to be straight up and point out that you paid to park and had no advantage in knowingly not displaying.

 

If this appeal fails, then you need to decide whether to pay at that stage, or pursue the matter (whereby you would then be forfeiting the option of just paying at the discounted rate).

"pay and display carries two conditions" probably. It depends on the Order. some have been found to only specify the pay part.
