    • Well, you've highlighted the problem yourself, whatever you decide will carry some risk.   However, I would think the risk of a default judgement & CCJ is to be avoided at all costs and the least worse thing would be to write them a two-line letter with their reference number and your new address.   As usual, any details you can give us on the forum sticky would be useful for the future

      I was in Sainsbury’s today and did scan and shop.
      I arrived in after a busy day at work and immediately got distracted by the clothes.
       
      I put a few things in my trolley and then did a shop.
      I paid and was about to get into my car when the security guard stopped me and asked me to come back in.
       
      I did and they took me upstairs.
      I was mortified and said I forgot to scan the clothes and a conditioner, 5 items.
      I know its unacceptable but I was distracted and Initially hadn’t really planned to use scan and shop.
       
      No excuse.
      I offered to pay for the goods but the manager said it was too late.
      He looked at the CCTV and because I didn’t try to scan the items he was phoning the police.
       
      The cost of the items was about £40.
      I was crying at this point and told them I was a nurse, just coming from work and I could get struck off.
       
      They rang the police anyway and they came and issued me with a community resolution notice, which goes off my record in a year.
      I feel terrible. I have to declare this to my employer and NMC.
       
      They kept me in a room on my own with 4 staff and have banned me from all stores.
      The police said if I didn’t do the community order I would go to court and they would refer me to the PPS.
       
      I’m so stressed,
      can u appeal this or should I just accept it?

Hello all, I am new to this forum and have been dealing with my DP with welcome. Back in January we sent them the template letter asking for a statement of account and signed credit agreement. We recived no response from this letter at all and if honest forgot all about it. That was until we recived a court letter apply to put an attachement of earnings on my OHs wages to take the money they felt we owed. We sent the court a letter along with a copy of the original letter we had sent to welcome back in january and heard no-more from the court. we then recived a statement from welcome with all transactions on the account from the start. This showed all sort of random charges, Add Hoc Fees ranging from £5 - £20 and call charges etc.

 

We added up all payments made and all charges applied and by there caluclations they think we still owe £1900 on a £2200 loan by our calculations we have todate paid over £6000.

 

As yet we have not had a credit aggreement and we are not sure what step to take next,

 

Im hoping that someone here may be able to point me in the right direction

was the letter from the court? or just one of welcomes threat-o-matic letters?...they cannot do an aoe without the court order!!

But welcome think they are above the law...An aoe cannot be applied without a court order!!

from what I can gather it was the application to the court for the attachment of earnings. but i could be wrong.

 

send a CCA request of to them, it will cost £1 and they have 12+2 days to respond with an original copy of your agreement. after that point if you don't receive it send in the next letter in which puts your account into dispute thus you can, if you so desire, cease payments. however if you let them take you to court they will have to produce the CCA and you can then question them as to why despite 2 prior requests and fee's paid (keep the postal order receipts and the recorded delivery reciepts) they have failed to provide you with this and also why they are persuing the matter further when you have had to get a DMP involved to deal with your poor financial situation.

 

also start reclaiming the charges...someone more knowledgeable can advise you better on that :)

also contact the court that was named in the application, explaining that you have had no notice of this and find out more from them, that will verify whether or not they have actually gone to court.
