    • read it proprly.. it doesn't say WILL anything and original creditors don't do court as they don't want the judge delving into their business model nor the bad publicity.   as for the FOS you just have to let it run. yours is a very short time since yo put it into them typically it always takes 6-9mts normally before they move on anything though they usually send you an ACK they have the complaint.        
    • Since the last post on this thread I have sent a complaint to the FOS but have not heard anything from them as yet either, I'm guessing they're rather snowed under and on reduced staff so no real surprise.   Still had nothing approaching help from lending stream but today they emailed me default notices for the loans, again demanding I phone them and pay up in full or they will begin court proceedings.   Any advice as to how I should proceed please?
    • Hi,   I received two PCNs in October 2019 from Havering Council. All the below applies to both PCNs, as the correspondences were at the same time:   Fast forward to February 2020, I file witness statements on grounds that I made representations within 28 days but did not receive a rejection notice.   The TEC cancelled charges.   Havering write to me asking for supporting evidence of representations that I made.   I email them screenshots with timestamps of the representations.   In early March Havering reply to me by email 'confirming receipt of email and both cases are now on hold pending an investigation. Please allow time for a full response to be sent.'   Fast forward to 18th June Havering write to me the attached:  Havering Charge Certificate.pdf   Now, it seems as though the sender of this letter is not up to date with both cases and is unaware of the TEC's decisions, as well as the email correspondence.   My questions are, 1) What should I do next? and 2) Is there a way to use their misstep to avoid paying for the PCN entirely?   Thank you.

      I was in Sainsbury’s today and did scan and shop.
      I arrived in after a busy day at work and immediately got distracted by the clothes.
      I put a few things in my trolley and then did a shop.
      I paid and was about to get into my car when the security guard stopped me and asked me to come back in.
      I did and they took me upstairs.
      I was mortified and said I forgot to scan the clothes and a conditioner, 5 items.
      I know its unacceptable but I was distracted and Initially hadn’t really planned to use scan and shop.
      No excuse.
      I offered to pay for the goods but the manager said it was too late.
      He looked at the CCTV and because I didn’t try to scan the items he was phoning the police.
      The cost of the items was about £40.
      I was crying at this point and told them I was a nurse, just coming from work and I could get struck off.
      They rang the police anyway and they came and issued me with a community resolution notice, which goes off my record in a year.
      I feel terrible. I have to declare this to my employer and NMC.
      They kept me in a room on my own with 4 staff and have banned me from all stores.
      The police said if I didn’t do the community order I would go to court and they would refer me to the PPS.
      I’m so stressed,
      can u appeal this or should I just accept it?

Buying debt and giving address for Credit Report

I have a couple of points that are different from the ones raised in my earlier post:


Has anyone ever been able to BUY their debt from a CC company or DCA? If I am to pay, say, 50p in the £1 to "settle it" then for a CC company or DCA does it matter how it is "structured"? IF I BUY the debt then I can make the necessary reports to the CRAs (report debt cleared etc) and also I know, since I own the "debt" no one else can chase me on it. A simple one page Sale and Purchase Agreement would suffice. Any thoughts?


On another topic, when I got to get copies of my Credit Reports from the CRAs (Experian etc) they ask for proof of address. If I provide will that information somehow wind its way onto my credit file? Will creditors be able to find it - or is it just between me and the CRA?


The reason for my query is that when I moved I had most mail forwarded to a PO Box (which refueses, on my instruction, to accept any recorded or signed for documents) so creditors have an address for me - but no way to serve me and it is not my residential address. Clearly the utility and other bills come to my home address - and it is these Experian want as "proof" in order to ensure they are sending the credit report to the right person (and I do agree with their approach).


While I want to see my credit report, I do not want to do so if it risks (however inadvertently) getting my residetial address into the public domain. Does anyone know a way around this?

Credit Reference Agencies have agreements with financial institutions about recording information and there is an industry-wide agreement about how that information is recorded. I doubt they would record information about how you conducted an account given by yourself! The CRAs are linked to certain DCAs and if you make a credit search sometimes a DCA comes out of the woodwork and tries to pursue you for a debt. As for your address, it would be posted on your report with the CRAs - it is one of the first things listed on your report and anyone who searches your reports can see it.

Thanks for the response. In terms of buying the debt, I would NOT do it myself but via a third party (company) so that the "settlement" with the DCC ocmpany or DCA would be along the lines of me informing them at X company wants to buy the debt for 50p say, and if they agree, that is one way (the only way) they are likely to get their money. Then it would be the purchasing ocmpany making the credit report - not myself.


On the address point, it sounds as if I need to skip this. Is there any way off accessing a credit report WITHOUT having to provide proof of address?

The purchasing company would have to be approved by the CRAs as a bona fide lender who had an agreement with them to make entries on credit reports. I expect one of the conditions is that they have a consumer credit licence. Since your address is one of the key ways of identifying you, your address has eo be given to access your report - there is no way round that.

I can confirm the above. My daughter recently changed banks and of course a search of the CRAs was made at the time. Within a couple of weeks, no more, she was receiving 'phishing' letters from several DCAs trying to see if she was the person they were after (she wasn't) but just her name(s) were enough to set this off.


Some of the letter were quite threatening, just assuming that she 'must' be the person they are 'chasing'.

The only person entitled to your Personal Finance details is a Judge not a DCA


Move all banking activity to another banking group if you have a dispute - your funds can be used to offset debts within the same group.

Be careful with Banking details (card/account numbers) as these can be used to take unauthorised payments.
