      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I have CCA'ed Lloyds TSB back on 1st July and got a response back Today 1st August.

 

It seems to me that they have sent me 2 printed out terms and conditions and not what I asked them for.

 

I have attached the letter

 

Please can advise me what to do next as I have just received a letter from MHA Collections demanding I pay TODAY.

 

Please help.

Its exactly what I have received in the post today too.

 

I love the bit about "we are endeavouring to locate the copy of your signed agreement, but please be assred we wold not have opened a credit card account without having sight of a signed agreement".

 

 

Can someone more experienced please advise on next steps. I had a call from their collection department at 8:30 this morning. I told them they had the wrong number and hung up.

Would this part of the letter make my claim for my account being unenforceable if no signed agreement is found, invalid?

 

"We point out that your credit card account has been in existance for some time and you have drawn down and repaid debt on multiple occasions, thereby acknowledging that your agreement is valid and enforceable."

 

What should my next move regarding getting the signed agreement?

what about the paraghraph containing:

 

"We point out that your credit card account has been in existance for some time and you have drawn down and repaid debt on multiple occasions, thereby acknowledging that your agreement is valid and enforceable."

It now seems Lloyds have passed the account over to their in-house DCA offering to lower the payments to £273.67pm fo 6 months...thats nice of them...NOT!

I sent a SAR request to Lloyds TSB back on the 24th Aug 09 via Recorded Delivery. 40 days passed, so I sent a chase letter. Got a reply today saying the original one was not received and If I send another £10 and complete the form which was enclosed with their letter they can responded with the information required.

I have proof (Digital Signature) that the original recorded delivery was actually delivery on the 26th Aug 09.

 

I really dont want to send another £10 or wait another 40 days.

 

What should my response be..

I'm not sure, but I think you can send them a letter advising them that you have followed the correct protocol and perhaps give details of the recorded delivery. Also let them know that you are filing a complaint as they have failed in their statutory requirements.

you can get into a fight with them or you then simply swallow your pride for the moment and go in and get the SAR that you need.

 

If you get locked into dispute, they will be able to channel you off into an eight-week investigation and then six months to one year investigation by the ombudsman.

 

I would suggest that the best thing to do is to make a formal complaint -- and enclose a copy of the recorded delivery receipt evidence -- and tell them that you want to brought before the ombudsman. Make sure that you follow this through all the way.

 

Meanwhile provide them with another SAR -- fully paid -- but this time and it into your branch to the manager and tell them that you want a receipt. They won't like to give you a receipt but if you are prepared to become loud about it, then they will probably give you what you want. They will invite you to come and meet the manager in some little room. This is not for your benefit. It is for their benefit so that the public not able to see or hear what goes on and are not able to witness you serving them with an SAR and demanding a receipt. When they invite you to go into an office, refuse and tell them you want to deal with the matter there and then.

 

And the manager the SAR and the payment. If they really won't give you a receipt, then take a note of the time and also the name of the manager you are dealing with. Then write to the branch and also write to Lloyds data protection officer and confirm that you have supplied an SAR to their branch on such and such a date at such and such a time to such and such a person. Point out to their data protection officer that this is the second time that you have served them with an SAR and if there is any more funny business, you will simply put the matter before the County Court.

 

I don't think that there's anything more than you can do in your best interests.

 

Don't forget that Lloyds TSB is not to be trusted
