Hi All

 

I was hoping for a little help here please. I have had a credit card through my bank (lloyds) for as long as I can remember and it has always had PPI on it. Never told I could cancel it or get it elsewhere.

 

I am hoping to get some money back but not sure where to start? I have read the template letters but I dont know when I first got my card from the bank or how much I should ask for back?

 

Any suggestions would be gratefully received, I have two small children and lost my husband last year, so all savings and pennies means a huge amount to us.

first port of call is to fire off an SAR.

this will get you all the statements, then we can calc from there what they owe you.

 

at the same time i would include a letter CANCELLING the PPI forthwith.

when drafting the S.A.R letter also request a copy of your agreement.

I would be grateful if you would provide the following for ALL accounts or associated accounts I have held with your organization:

-Full copies of all contracts which you believe exist or have existed between myself and your organization, including true copies of any documents you hold in support of the same.

 

- A complete list of all transactions or statements relating to ALL of my Loan Accounts and or credit card with your organization.

 

-Copies of all documents which include any of my personal information including copies of any contacts or invoices, emails or computer records containing my personal information, or any records which pertain to this information.

 

-Full copies or transcripts of any correspondence in postal, email or any other format which you have entered into with any individual, organization or third party which contains my personal or financial, or which pertains to me.

 

- Where any previous information or records held have been deleted or disposed of, the methods used to do so, including dates, certificates or references confirming details of destruction. Where you are unable to provide such certificates, please provide a declaration, signed by an authorised officer of your company, confirming the dates and methods of destruction of this data.

 

-Full hard copy print outs of my personal or financial information, held in a digital, magnetic or any other format which is held in any archives, backups or other storage devices / locations.

 

I enclose a cheque in the sum of £10 to cover your fee.

They have 40days to comply under the Data Protection Act, but do be nice and allow some time for postage. Which should always be by recorded delivery, so you can prove that they did receive it.

Hello,

 

I have sent the SAR letter to the bank as suggested, it was signed for two weeks ago.

 

Do I leave it the full 40 days or so, (allowing for postage time) or should I send a reminder at some point?

They have 40 calendar days by statute (Data Protection Act 1998 8)

 

If they go one day over you can either complain to the Information Commissioners Office or start Court procedings. Your choice.

 

You will need legal advice if you go down the Court route when I say legal I mean from the CAG forums here..Legal Issues

 

I have no legal training and the advice I offer is a matter of support. Before you commit to any Legal action you are advised to contact a qualified legal practitioner.

Bank charge successes:

Halifax - Full settlement incl interest.

HSBC - Settlement, goodwill no admission of liability about 75% of claim.

RBS - Settlement, goodwill no admission of liability about 70% of claim.

2 ongoing claims for bank charges with HSBC with more to come. (Supreme Court ruling could have upset these claims) They did :mad:

PPI Successes

PPI 4 settlements on 9 loans. FOS involvement on 7 added on the 8 % Statutory interest another 30% to both.

2 claims settled in full with LV without FOS involvement.

2 claims settled in full with HSBC without FOS involvement

 

PPI Claims ongoing with:

Cap one Now with the FOS

Barclays. Paid up today 24/04/10 cheque received for over £4,500 and in the bank.

LTSB still have to decide on this as their SAR production was abysmal. Papers data mixed up documents missing etc

 

1 Complaint not upheld by FOS they said it was ICO issue. Complaint upheld by ICO. See this..

(you should be able to work out what to claim once you have all the details ie cca, statements, and all other data/paperwork that you should ask for by submission of a Subject Access Request (see below)

 

Is there a formula for working these things out? There are various formulas for working out what you can claim they differ from credit cards to loans but you will get help in the calculations and there are spreadsheets and interest calculations information on the cag website.

So sorry to hear this news. I have had two of my kids recently in Afghanistan and Iraq.

 

You will need to start with a request to get all of your information from the banks ie all the data they hold.

Full SAR for ppi

 

Data Protection Act 1998 - Subject Access Request

 

You can be specific with what data you request although the Subject Access Request is really asking for everything. The Statutory fee is £10.00 Postal Order is fine but keep the details of the number for future reference. The post office will be able to confirm when it was encashed (just call 01246 542091 they will even send written confirmation if you request it) Send all correspondence by at least recorded to be signed for so you can track delivery through Royal Mail

 

You should request the following documents:

 

A true copy of your Consumer Credit Agreement with the Terms and Conditions that were applicable at the time you took the loan/card/mortgage.

 

Copies of all statements applicable to the loan/card/mortgage.

 

Copies of all correspondence that apply to you as a data subject ie letters, emails, faxes etc.

 

Copies of all recorded telephone calls or transcripts of the recordings.

 

Copies of any notes made by bank/loan company staff in their dealings with you as a data subject.

 

Do not be fobbed off by them citing issues such as relevant filing systems.

 

If they have any records/data on you as a data subject and it is held under your name, address, post code, account number/s or any other system where the data is identifiable to you then it is a relevant filing system. Even if it is a specific serial number on microfiche records and the serial number is applicable to you.

Very sorry to hear of your sad situation.

 

Although I have no experience of credit cards with LTSB I know they can be totally unsympathetic and uncaring when it comes to cases of personal tragedy, which I do know from personal experience. All they care about is getting their pound of flesh.

 

However low you feel (and LTSB do seem to enjoy playing tactical games in an effort to put you off, which don't help the situation) you must try to remain strong, in control of the situation and don't let them win!

 

You will get plenty of advice here, on the PPI front from alanalana and Pompeyfaith especially - they are the resident experts - and there is always someone around to listen and offer support:)

I can help you with this but to do the calculations we will need dates of each payment, the payments made and the relevant apr at the time of each payment.

 

This will all be on your statements so soon as they arrive let us know then i can help you a start putting a claim together.

Thank you everyone for your advice and support, I dont feel quite so fraught now!

 

So I finally had an acknowledgement letter from the bank stating that they had received my subject access request and my £10 etc and would start putting together the information i had requested, they said they would be taking the 40 day response window from the date they got my letter and I would have the information by 19th September. Date on calendar.

 

Although rather kindly of them they also sent the same letter to my deceased husband as it was a joint bank account we had with them. Thought it was a nice touch..:rolleyes:

 

Made me laugh that the same day I also got from them a leaflet on the banking code etc...

 

Rather oddly am looking forward to the information coming through, it will give me something new to focus on for a while.

Hi All

 

I hope everyone is okay.

 

Wow, okay so today (one day short of the deadline) I got a huge bundle of stuff from Lloyds.

 

some points to highlight - first, all of the stuff is not there, credit card statements provided start at 2004 - yet they have included the signed credit card application form dated 2000. So there are 4 years worth of statements missing. Second, there is no loan statements etc which I requested. Should I send a further letter on these outstanding points?

 

On the credit application form from 2000 it shows the box ticked for ppi, am I still able to make a potential claim?

 

If I am still able to make a claim... where on earth do I start working out the amount. Do I need to wait for all the other outstanding to come through?

 

Feel like Lloyds know what is in the offing, and are playing silly beggers with me slightly by not providing all the data. And, yet again, addressed the data to me and my deceased husband!! It is getting quite upsetting them doing this. It's not like they don't know!

I wonder if they are playing the 6 year rule, hence why no statemnets before 2004

even if they where they would still be 1 yr short as 6 yrs would be to 2010 anyway the 6 yr rule does not apply to mis-selling a product

And AA said on my Barclaycard thread that on SAR request the 6 years count from when you close your account, meaning they have to keep all the records for 6 years after your account is closed - NOT that they only have to supply the previous 6 years statements on a current/active account.

Furthermore according to the Cag data poll there are caggers who have had data as far back as 1995 from barclaycard.

 

Draw your own conclusions from that.
