Story so far :-

 

LloydsTSB Mastercard held for many years.

 

April 2007, send subject access request (at this time only asking for Bank Charges, because I hadn't found C.A.G. ) and fobbed off with, sorry SAR's don't apply to Credit Cards.

 

Mar, 2008, find Martin Lewis's website and again send S.A.R. fobbed off again.

 

Find C.A.G. and send off Section 78 CCA on 29th December, 2008.

 

Letter dated 6th Jan, 2009 from Lloyds saying I am in arrears

 

Letter dated 22nd Jan, from Lloyds saying thanks for your request but we've got a high volume of request, in the meantime don't get behind.

 

Letter dated 23rd Jan, from Lloyds saying we've had a lot of requests so we're reviewing out processes so we can provide a comprehensive response.

 

Letter dated 27th Jan from BLS saying cough up or else

 

Letter sent by me on 30th Jan to Lloyds saying that they fobbed me off before, but I've not got every reason to believe that the SAR was justified and here's my £10.00, oh and by the way call off BLS as account in dispute and has bee since date of original request of April, 2007. Letter sent by me to BLS pointing out that account in dispute.

 

Letter dated 4th Feb, from Lloyds monthly repayment increased.

 

Another letter from BLS dated 20th Feb.

 

Letter dated 24th Feb from Lloyds stating thanks for your request under Data Protection Act 1998, and here is a list of charges on your credit card account.

 

Letter from me dated 23rd Feb to BLS saying Account in dispute, give itback to them.

 

Letter dated 16th March, from Lloyds saying upping payments.

 

Nice yellow card dated 20th April, 2009, from Allied International Credit, informing me that formal demand has been made by Lloyds therefore full outstanding payment should be made straight away.

 

Letter from me on 3rdMay to AIC pointing out account in dispute because Lloyds failed to comply with CCA.

 

LBA dated 6th May, from me to Lloyds.

 

Letter from Lloyds dated 15th May, stating that sorry you've had to complain, putting out top man on the case.

 

Letter from lloyds dated 19th May sorry but we've received a high number of requests but we'll come up with it eventually.

 

 

During the next 4 weeks I'm in and out of hospital due to various medical problems, the worst of which was a heart attack, from which I am in the process of recovering.

I would appreciate advice on my next move, please.

they sent you a hundred bits of paper?

 

I would set all of the above out in a letter and send it to lloyds and a copy to the fos and complain like mad about their antics.

 

also inform allied that this account is in dispute and that you will not be dealing with them, at any time

 

Thanks PGH, I am in the process of putting a letter together to FOS, and you've thankfully endorsed my thoughts on that. I was wondering if there was any other course of action to be taken.

 

I was rather amused by what they sent me, how gullable do they think people are. "We can't find your agreement, but if we could, it would say this, but we've amended it anyway, so we don't have to produce it because the law's been changed since you took your agreement out, you know, the one we can't find, so on the strength of that - pay up"

Got it Acorn, yeah I am getting the same sort of problems with them, so I wont bother with the letter I was considering sending, I will SAR them at the end of the month (bad bill month run out of dosh) and do complaint to FSO (for what its worth with them).

After 18 months LlyodsTSB have eventually got round to sending me a response to Section 78 CCA request:-

I think it's interesting to note that they have put TSB Bank plc as one party to the Agreement (indicating that the account was opened pre 1995) but they have used an address for me which I only moved into post 1999, indicating, of course, that it's NOT a reconstituted version of my original agreement.

 

I would be grateful for anyone's opinion on what they have sent me, and perhaps some advice on my next move.

I'm not as knowledgeable as a lot of more informed people on here, but where is all the terms that are supposed be on there, like charges and other fees, and all those pages of terms won't fit on ONE document even if it has both sides filled in, so it just shows that it is not a TRUE copy of the agreement. So in my eyes it is not anything like it either. I have only just realised that I have never had anything back from my SAR request.

Charges are actually under Paragraph 9, but that just lists interest charges, there are no late payment fees etc., listed anywhere.

At least you have had a reconstituted agreement, all I have ever received is a photocopy of my March 2009 monthy card statement which is what they state in their letter accompanning it, is the Enforceable Agreement. So if they wanna go down that road to court I am 100% willing to go there, and I will apply for legal aid and take them the whole hog and make them pay big time. Even better now that I remembered that they have not answered the SAR, means that they have failed on at least 2 major things, legal requests. So come on Lloyds/TSB I am waiting for you. Stick your money where you mouth is and take me to court.

Report them to the ICO for non compliance of the SAR.

 

 

Tried that, all you get is a letter stating that they've investigated and Lloyds TSB have conformed ? Or with another card I had with Lloyds TSB, the FSO wants to see MY credit file, WHY?

Personally I would just sit and wait, don't do nothing, you still have to wait for the reply for the FSO, so they can't do anything until that is investigated. Then they will probably do exactly the same as me, pass it to a DCA, and you know what to do with them, same as me see 'em off. But be warned they did try and send it straight to a solicitors not to DCA, but I have seen them off as well. ....
