    • 4 means that they need to name and then tell the people who will be affected that there has been an application made, what the application relates to (specificially "whether it relates to the exercise of the court’s jurisdiction in relation to P’s property and affairs, or P’s personal welfare, or to both) and what this application contains (i.e what order they want made as a result of it) 5 just means that teh court think it is important that the relevant people are notified 7 means that the court need more information to make the application, hence they have then made the order of paragraph 1 which requires the applicant to do more - this means the court can't make a decision with the current information, and need more, hence paragraph one of the order is for the applicant to do more. paragraph 3 of the order gives you the ability to have it set aside, although if it was made in january you are very late. Were you notiifed of the application or not?    
    • These are the photos of the signs. At the entrance there is a 7h free sign. On some bays there is a permit sign.  Also their official website is misleading as it implies all parking is free.  I can't be certain of the exact parking bay I was in that day, and there was no PCN ticket on my car and no other evidence was provided.  parking sign 2.pdf
    • Hi, In my last post I mentioned I had received an email from SS who were asking me to hand over the keys to my mother’s flat so they could pass them to the Law firm who have been appointed court of protection to access, secure and insure my mother’s property.  Feeling this, all quickly getting out of my hands I emailed ss requesting proof of this. I HAVEN’T HEARD BACK FROM SS.  Yesterday, I received an email (with attached court of protection order) from the Law Firm confirming this was correct (please see below a copy of this).  After reading the court of protection order I do have some concerns about it:   (a)   I only found out yesterday, the Law firm had been appointed by the court back in January.  Up until now, I have not received any notification regarding this.  (b)   Section 2   - States I am estranged from my mother.  This is NOT CORRECT    The only reason I stepped back from my mother was to protect myself from the guy (groomer) who had befriended her & was very aggressive towards me & because of my mother’s dementia she had become aggressive also.  I constantly tried to warned SS about this guy's manipulative behaviour towards my mother and his increasing aggressiveness towards me (as mentioned in previous posts).  Each time I was ignored.  Instead, SS encouraged his involvement with my mother – including him in her care plans and mental health assessments.   I was literally pushed out because I feared him and my mother’s increasing aggression towards me. Up until I stepped back, I had always looked after my mother and since her admission to the care home, I visit regularly.   .(c)    Sections -  4, 5 and 7  I am struggling to understand these as I don’t have a legal background.  I was wondering if there is anyone who might be able to explain what they mean.  It’s been a horrendous situation where I had to walk away from my mother at her most vulnerable because of; ss (not helping), scammer and groomer. I have no legal background, nor experience in highly manipulative people or an understanding of how the SS system operates, finding myself isolated, scared and powerless to the point I haven’t collected my personal belongings and items for my mother’s room in the care home.  Sadly, the court has only had heard one version of this story SS’s, and based their decision on that. My mother’s situation and the experience I have gone through could happen to anyone who has a vulnerable parent.    If anyone any thoughts on this much appreciated.  Thank you. ______________________________________________________  (Below is the Court of Protection Order)  COURT OF PROTECTION                                                                                                                                                                                   No xxx  MENTAL CAPACITY ACT 2005 In the matter of Name xxx ORDER Made by  Depty District Judge At xxx Made on xxx Issued on 18 January 2024  WHEREAS  1.     xxx Solicitors, Address xxx  ("Applicant”) has applied for an order under the Mental Capacity Act 2005.  2.     The Court notes (my mother) is said to be estranged from all her three children and only one, (me) has been notified.  3.     (Me) was previously appointed as Atorney for Property and Affairs for (my mother).  The Exhibity NAJ at (date) refers to (me) and all replacement Attorneys are now officially standing down.  4.     Pursuant to Rule 9.10 of the Court of Protection Rules 2017 and Practice Direction 9B the Applicant 2must seek to identify at least three persons who are likely to have an interest in being notified that an application has been issues.”  The children of (my mother), and any other appointed attorneys are likely to have an interest in the application, because of the nature of relationship to (my mother).  5.     The Court considers that the notification requirements are an important safeguard for the person in respect of whom an order is sought.  6.     The Court notes that it is said that the local authority no longer has access to (my mother’s) Property.  7.     Further information is required for the Court to determine the application.  IT IS ORDERED THAT  Within 28 days of the issue date this order, the Applicant shall file a form COP24 witness statement confirming that the other children of (my mother) and any replacement attorneys have been notified of the application and shall confirm their name, address, and date upon which those persons were notified.  If the Applicant wishes the Court to dispense with any further notification, they should file a COP9 and COP24 explaining, what steps (if any) have been taken to attempt notification and why notification should be dispensed with.   Pending the determination of the application to appoint a deputy for (my mother), the Applicant is authorised to take such steps as are proportionate and necessary to access, secure and insure the house and property of (my mother).   This order was made without a hearing and without notice.  Any person affected by this order may apply within 21 days of the date on which the order was served to have the order set aside or varied pursuant to Rule 13.4 of the Court of Protection Rules 2017 (“the Rules”).  Such application must be made on Form COP9 and in accordance with Part 10 Rules.              
    • Unless I've got an incorrect copy of the relevant regulation: The PCN is only deemed to have arrived two days after dispatch "unless the contrary is proved" in which case date of delivery does matter (not just date of posting) and I would like clarification of the required standard of proof. It seems perhaps this hasn't been tested. Since post is now barcoded for the Post Office's own tracking purposes perhaps there is some way I can get that evidence from the Post Office...

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

On my way to a meeting in my city centre today, i notice a pigeon bird in distress & needing help.

Everyone else was walking by & not giving a stuff :(

So i ring emergency services, i get phoned back 10 mins later off RSPCA - this obnoxious woman was demanding that i go back to were it was, put it in a box & take it to RSPCA centre.

Errr were do i get box from & were is centre :confused:

I felt like a criminal.

Remind me to just walk on by next time like everyone else :mad:

I remember spotting an injured bird when I was walking my dog. It was a bit larger than a pigeon (a hawk of some kind). Any way, like you I phone the RSPCA. They told me to catch it and take it to the nearby shelter!!!!

 

Yet you see on these animal rescue programes these people going out and recovering all sorts of wildlife.

Shame, it's a sign of the times, isn't it?! However, I do know that the RSPCA and other organisations do a wonderful job and let's just hope they are genuinely busy dealing with other emergencies at the time. Don't forget that pigeons are classified as vermin, along with squirrels in this country. Albeit a shame :(

The RSPCA came out to my neighbour a few weeks ago because a Goshawk was injured in their garden. The RSPCA took 4 hours to get there, then the bird flew off!!!

One of the students where I work threw a rock into the air and struck a seagull a few months back.:mad: The poor creature crashed to the ground; stunned, but still alive. You'd not believe the number of staff who thought it comical.... yet a cohort of us were appalled by the behaviour and wanted the student to be brought to task for it. Arrangements were made for the bird to be taken to a local wildlife rescue centre, but unfortunately.... it didn't survive. The student was shunned by other student for weeks afterwards though....which made life difficult for him.

 

Those same staff soon changed their minds when a rock was chucked into the middle of the road the following week by someone else though; striking a car windscreen... causing it to swerve dangerously in the road and.... which had a baby strapped in the back of it!

This woman on the phone was so rude & obnoxious it was unbelievable.

I was with someone speaking in a near-by building & couldnt just get up and leave straight away...but she wasnt having any of it & was demanding that i did :mad:

I was told as well that 999 was not the correct number to have phoned for such an incident.

Since when has an animal being in distress not been an emergency & not been worthy of an emergency response?

Do they not have feelings/rights or something? :mad:

Im sorry to ramble on....but i also wish i could have knocked out the idiot who stopped briefly, had a look,saw the creature in distress,started laughing & pretended to fire a gun at it type of gesture...

Just what planet are some people on these days? :mad:

I remember a couple of years ago seeing a young fawn being hit by a lorry, OH and I stopped and the poor wee thing was still alive - just. Called the vet, who told us to call the police, as if he was to come out on our call we would be charged a vet fee. Called the police, who then called the same vet. Poor wee thing didnt survive though.

Reminds me of my poor moggy, when he was young someone shot him with an air rifle, pellet hit his spine and he limped evermore after we'd spent nearly £400 in vet fees to get it removed rehab and the likes...anyway, nearly 20 years later and new neighbours moved in around the back of us. They came home late one night and our moggy was, as always, wandering around outside ( He liked using the catflap) seeing hop-along hobbling around they thought he'd been hit by a car and called RSPCA who came out and took him miles away to the Putney Centre, we searched high and low for him not knowing where he was until nearly a week later the RSPCA said that one of their vans picked him up but didn't know where he was taken because the van driver was off...eventually, just a few hours before he was sent prematurely to his maker we found out where he was and saved him. Just one of his 9 lives before he eventually did go to his maker last Christmas aged 23 RIP!! :D

 

Oh and Priority One - that picture still sends shivers up my spine! :wink::D

When I was about 9 I found what I believe was a Perigrine or some other bird of prey outside my house with a damaged wing.

 

I knew someone who looked after birds, and he said it would just be put down. I took it home with me in a box and fed it for a couple of weeks. It even used to perch on my hand (I was wearing gardening gloves) quite happily. It eventually flew off but it did come back to the garden a few times.

 

I can't believe people would have wanted to put such a beautiful bird down.

This whole "tick box", "someone elses responsibility", "scared of litigation" culture just angers me so much :mad:

 

Sorry mr.ton slightly of track, actually a completely different subject:

A friend of mine has two sons both under the age of 12. One day 2 12 year old boys were bullying one of her sons (9yrs old) in the local park, he got Pee'd off and punch one of the boys in the shoulder, no damage done. The boy called the police, my friends son came home & told his mum. They waiting for the police, nothing happpend. Some three months later my friend rec'd a call from the school saying police had arrived and wanted to spk to her. They told my friend that her son could be charged with assualt, she pointed out that he was defending himself. She was absolutely furious and sent the police officer away with a flee in their ear.

 

Next incident. Other son (11 yrs old) was in the park saw two boys (13 yrs old) taunting another younger boy with a very sharp pencil, one of the boys started to make stabbing motions with the pencil to the younger boys neck. My friends son went over to the boys and told them to stop. One boy continued and it looked as if he was actually going to stab the young kids neck, so friends son grabbed the boys arm to stop him doing so. Guess what, police were called, my friend was called to the police station and told that he could be done for assault. Can you believe it, he had tried to stop someone from getting hurt, he didn't hurt the arm of the other child. It seems the police are quite happy for us to bring up our kids with the attitude of don't stand up for yourself, and don't try to help anyone, if you do we may arrest and charge you. Crazy world we live in.

sorry to disagree here guys, but let me think about this for a second?

 

 

999 for a pigeon in distress seems slightly disproportionate to me, no matter what the situation.

 

who did you expect to turn up? a traffic car with a blue flashing light, hurtling though town jumping red lights, overtaking on the wrong side of the road, just to get to....................a pigeon?

 

 

or maybe an ambulance? sirens blaring, never mind the old bloke who's just had a heart attack, or the young lad been knocked down on his bike, or the car crash victim...........there's a pigeon to get to!!

 

I know..........a fire engine, all the fire officers, down tools from their proper jobs, drive as fast as they can to get to the station , because there's a 'shout'.........only to find that it's for a pigeon!

 

 

Like AA99 says......it's classified by law as vermin, so deal with it appropriately, and don't waste a huge amount of public time, money and emergency services on it, and blow everything out of proportion on the feelings and rights of a pigeon!!

yes I am with you on this Charleyfarley I love animals and birds but to call 999 for an injured pigeon is just ridiculous. Nature is cruel and I am afraid lots of animals will be in distress in the wild without anyone being any the wiser.

When I was reading this thread I could not believe that nobody else thought it es over the top. Reason must come into this. A wild creature is a wild creature

Do you think god (or who/whatever) decided to call it vermin when the world was created? We are all creatures of equal validity on this earth - it's just humans who think they have more rights than anything else - (and I'm no bible puncher my friend). Where's your heart Charley? ( but I understand what you're saying.)

 

Story above reminds me again of said moggy of mine and bullying. My front garden has a slope into the garage below my Kitchen, the kitchen and living area is level with the road and we have steps up to the front door.

 

One morning said moggy was walking about in front of the house on the roadway and I could see him from the kitchen window -it's a quiet driveway so he was quite safe and spent much of his time out there playing with foxes (yes!) A young lad arrived on his bike to deliver papers to the house next door dressed in his white shirt and tie, school blazer etc ready no doubt to scoot off to school after his paper-round. Laying his bike down he looked at moggy and wiggled his finger effectively inviting said moggy to come and be pampered. I watched and felt pleased on this sunny morning (7.15 ish) that this nice young lad wanted to pet my bundle of fluff, especially as he'd been in major surgery a few months earlier with a massive slice along his back getting this air-pellet out and 6 weeks in the vets getting physio treatment.

 

The cat, being the friendly thing he was, walked gently to this lad who then ventured his boot into moggy's ribs and sent him scurrying into the bushes across the road.....:eek: Needless to say you don't need much imagination to know what I felt, so whilst this laddie gathered his papers to put into next doors letter box at the top of their stairs I found myself in auto-pilot, in my jimmies and dressing gown on my way outside.

 

The lad was at the neighbours door when I found myself at the foot of the steps and I did much as he did to the cat and gestured to him to come down, I said it gently so as not to alarm him, when he got down to my level I gave him the biggest crack across the face I could muster with my hand and warned him never to lay a finger on an animal like that again. My hand stung for ages, the kid raced off on his bike stunned I'd seen him do it calling me all the W**kers under the sun as he fled and I went in search of my poor cat.

 

I then phoned the newspaper seller and told him what had happened and needless to say the lad was not seen ever again.

 

I had visions all day of coming home from work only to find a burly Mum and dad standing there waiting to clock me one too, but alas that never happened as I'm sure the lad never told what he'd done...bet the fecker never does that again in a hurry - assualt? Yes and proud of it! :-D

 

I think the moral of that and what made me so mad was the fact the cat was lured into a false sense of safety before being kicked - sounds a bit like some of these finance companies and banks doesn't it?

So much wild life gets killed each day..foxes most ,,then the men in red coats go and kill some more..I thought we were a nation of animal lovers..

 

The poor little pigeon must of been stressed..But they do say leave nature alone! I had a wood pigeon injured in my garden a few wks back..i knew he wouldnt survive..I put him in the aviary to keep him away from preditors with water and seed..4 hrs later he died..checked him over had wounds on his breast,,Pellet gun, cat who knows! even tho i couldnt save him i felt that his last few hrs were safe so felt better for that..The RSPCA and the RSPB arnt intrested the only place that would take a wild bird is a wild life sanctuary in my experience

I've seen people walked past humans lying on the floor who obviously need help. I don't see why people would do more for a pigeon than they would for another human.

Can i just stress something for the arrogant humans here who think animals are worthless etc...

I am not saying that the police, fire or ambulance should attend the likes of an injured bird - i made the call that i did & requested the details of the RSPCA saying that i knew id no doubt dialled the wrong number, but didnt know were else to ring at that moment in time - it was then that the operator forwarded my details onto the RSPCA who then phoned me back etc...

Please put this argument into context before making out that the likes of 999 should be an everyday occurance for injured birds etc...:mad:
