Hi there,

Basicly I ran a credit card debt up and was pursued by a company called CapQuest, balance was £3617 and I agreed a setlement figure of £2500, saving £617.

 

The above account was settled and closed in July last year but back in June this year I recieved a demand from Mcs for £617, I rang them and told them it had been settled but all they would say is they have no other info other than that i owe HSBS this amount.

 

Rang HSBC but they were usless, had no info to provide and just deal with Mcs, went round in circles.

 

Wrote to Mcs and explained that it had all been settled with CapQuest in July 08 but only response I got was a letter saying they were going to pass it over to DG solicitors and claim against my house.

 

Sent anotther letter putting monies owed in dispute along with request for CCA and breakdown of debt owed with postal order for good measure.

 

I contacted CapQuest and they sent me a letter of satisfaction, debt settled and account closed, all be it dated July this year, said letter is winging it's way to Mcs by recordered delivery.

 

Just wondered if there are any thoughts as to why I would have had no corrispondance for almost a year from HSBC and now this?

Hi barbarawoo , welcome (back?) to the forum :)

 

If you have incontestible proof that this was settled , let MCS do their worst . They are only a collection branch of HSBC , not a proper DCA - and all this huffing and puffing about claims against your house is designed to scare you into coughing up money which you do not owe. They can't put a claim on your house without going to court , and they won't go there - because they'd lose big -time .....

 

If they persist after you have your latest submission , report them to the Financial Ombudsman for harassment and unfair practice .

 

Come back if you need more info ,or if they're still playing silly beggars and we can put together a letter for you to wipe the floor with them................ :D

Incidentally , DG solicitors only work for HSBC , like MCS - they are in-house and pretty pathetic IMHO .:cool:

Metro and DG work out of the same office block in Edgebaston, Birmingham. I would be supprised if there was any more than a flimsy office partition between these two "companies"... if that :rolleyes:.

 

If Capquest have confirmed your agreement then you have nothing to worry about from the bully boy tactics od Metro, they arnt very good at it anyway lol

Hi Barb,

 

I think what may have happened here is you have fallen into the trap.

 

I bet the offer from Capquest was in PARTIAL settlement.

 

They have had the meat from the bone and have thrown the bone to the dogs.

 

Shame you paid these parasites anything.

 

Would there be any unfair charges you could reclaim on the account?

Hi,

full wording on the letter from CapQust is as follows...

 

Dear Barbaraxxxxx

Account Number: xxxxxxxx

Balance: £0.00

 

We thank you for your payment.

 

I can confirm that your account is now settled and closed. As the amnount paid to settle your account was less than the full oustanding balance, your credit file will show your balance as satisfied with a special flag of partial settlement.

 

Yours sincerley

Yes, it makes a huge difference.

 

The account is settled for Capquest, as I said, they have had more than enough from you. They have probably returned the rest of the account.

 

If you have charges on the account, I cannot urge you enough to reclaim them. It's simple and very rewarding :D

Well lets hope MCS accept the letter of satisfaction, maybe they will be too busy with so many peeps from this forum tying them up in knots :)

Yes , no problem barbarawoo....... if there are unlawful charges on it , start getting the ball rolling to claim them back .....

 

I take it we're talking about the Credit Card Account here ?- if so , that's not affected by the OFT Test case so just carry on and best of luck .........

 

And of course , if you're in doubt about how to proceed - you know where to come and ask ..... lol :D

 

BTW - I liked that light relief link ....... a good laugh! :lol:

Hi everyone, hope your all well.

 

Update of my case/problem?

 

Recieved a letter from MCS dated 4th August, delivered 7th August and reads as follows:

 

Dear MS you owe us money please paye up,

Thank you for your recent correspndence, dated 23rd July 2009, the contents of which have been noted.

 

Please be advised that matters will be held in abeyance pending our receipt of the satisfaction notice from Capquest. Once we have recieved this, we will refer back to our client.

 

We trust this clarifies matter.

No mention of my request for the copy of CCA?

 

No mention of my request for the following:

A validation of debt with complete breakdown of what is claimed to be outstanding

An assignment of debt letter authorising you to pursue the disputed monies

My letter was dated to them on the 23rd July, they recieved it on 27th July, Monday after the weekend it was sent from Friday.

Whats next? what date do they have til to respond to my CCA request?

As an aside, my husband told me this joke:

A sheikn has 3 sons, on the eldest sons 14th birthday he asked him what he wanted, the boy says a car set, so the sheikn buys him Jaguar motors.

The next son reaches age 14 and the sheikn asks him what he wants, the boy says, I want a train set so the father buys him Great Northern Railways.

Hi all,

not recieved anything else from MCS since their last letter as posted, nothing regarding my request for the following:

 

Copy of CCA, £1.00 postal order enclosed

 

A validation of debt with complete breakdown of what is claimed to be outstanding

 

An assignment of debt letter authorising you to pursue the disputed monies

 

I am in the process of drafting my next letter to them and will post before sending via Recorded Delivery for any sugestions.
