    • then the who thing cannot have anything to do with paypal then, they cant be involved at all. chargeback fee? from whom never heard of that one either. ebay/paypal must have changed their T&C's again then since the demise of brexit and EU agreements. i can only assume he paid paypal, who acted solely a payment intermediary, to buy your trainers from ebay. and ebay added a £14 processing fee? thats unlawful hence their refund. i dont think there is anything you can do here sadly. classic ebay scam that goes back +30yrs. just now rejigged for the 22nd century.  typically it only resulted in an unenforceable paypal balance that you simply walked away from... but now ebay has obviously tightened up on losing out to these scammers and added an unlawful fee to scrap some of their historic losses back.

Debt management and Debt self-help - Consumer Action Group click the above link and go read a good 20+ thread in the above forum and all your questions will be answered  if you have any outstanding  then please post with them later. everything is explain in numerous thread already here for you to understand at your own pace. there is not rush to do anything today or the next 10days bar simply stop paying. though as explained in my last post, whichever way you go not pay will equal a default which will trash your credit file for 6yrs so the quicker you stop the quicker they will vanish . dx

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

hi nick just bin readin your thread an its frightened the s--t out of me now!! i just started my claim last week an also felt better finding this site safety in numbers eh? they cut my overdraft from 3k to 2k so that prompted my action as i reckon my fees will cover the overdraft. i have opened a new account elsewhere this week and will begin movin my dd,s over i hope you win

Hi mescalero, it is frightening but the way to look at it is you've got nothing to lose. They will either pay up or they won't, but everyone on here says they will pay up... they don't have any options. That's what i'm clinging onto.

I got cold feet when my second letter 'LBA' got the usual reply of 'No' refund. I didn't know what to do even though this site tells you what u need to do. I guess the banks are relying on the fact that alot of people stop at the point. After i filled my claim form out & hand delivered it to my local court, i realised just how easy it was.

So don't worry, go with the flow, learn from the masters of claiming, there everwhere on this site, and in no time at all you'll have your refund. Don't forget to ask for the money in cheque form so you can then decide how much of the overdraft you wanna pay off.

ash, have you had acknowledgement of service from the court? If you have, then NW will have 28 working days from then to defend. From what i gather, they pay up, it appears alot later than they use to, so pretty much when the 28 days is up. My 28 days is up on the 14th being this Thursday, but i have to take into account the bank holidays i think so it'll run into next week. I haven't checked recently, my account, because it's frozen but i will go into my local branch tomorrow to check.

I've re-checked my account today and there's still a £500 shortfall.

So there were 4 corrections yesterday and none today. Is it just a question to keep waiting? Do i need to email or send a letter to anyone?

I'd wait until Monday. If there is still no sign of the rest then send an acceptance of partial settlement letter which lets them know you are not done with them yet. They'll pay up...eventually. I reckon they are just snowed under now.
