Update:

 

After ignoring my 'CCA' request and subsequent 'Account in Dispute' letter, HFC have sent me a letter stating my account is now in arrears and to make payment.

 

Seems like withholding payment is only action getting a response. I do not intend to make anymore payments unless they produce an enforceable agreement. Just wondering what my next step should be?

 

Do I:

Do nothing and see what they do next?

Or:

Send off another 'Account in Dispute' Letter?

If they have not sent you a CCA in the alloted time frame then you could do two things. Send them as you have rightly said another account in dispute letter (also include your previous letters for their reference) send it recorded or special delivery, don't sign your letter. And say that whilst the account is in dispute they can not enforce the debt etc.

Secondly you could report them. I know HFC is bogged down as I have been waiting for my subject access request since MAY!!!

If you want to you could just do nothing and see what they come back with.. Keep an eye on your account to see if they start applying charges etc because they can't apply them if the account is in dispute.

VICTORIES TO DATE THROUGH THE HELP OF THIS SITE:

 

1. Littlewoods Catalouge - No pursual of debt & wrote off £4500

2. Three mobile - Debt written off in full, all adverse entries including default removed from credit files, even got an apology from the Chairmans office

3. HSBC Bank - Partial refund for bank charges & claim lodged at court for outstanding charges.

4. HFC Bank - Ongoing - SAR'd in may- Going to register at court for non compliance.

5. Barclaycard - Being very awkward but Ongoing - These are a tricky bunch but they will fold before I do.

Hi Sallysas,

No am not sure withholding payment is legal..then again neither is their no reply to my CCA request.

 

If i put 'Account in Dispute' for failure to supple a CCA, then continuing payment defeats the purpose. As HFC are still being paid they will never produce one and I will be back to square one.

 

Anyone else have an opinion on this?
