    • I have just checked my credit file and Lowell have added this to my credit file in June, are they allowed to do this considering the accounts in dispute and they told me they had put the account on hold and had suspended all activity relating to the account, there is no marker showing for July.  
    • hi folks looking for some advice, purchased a set of alloy wheels through a company, that after 8 months wheels have started to erode, and were still under warranty, sent off an email, with pictures of all the wheels, it was not just one this happened on its all 4, after no reply, had put it down to them maybe been closed due to cover, and then called them a few weeks later, to see if they were open and had got my email, to be told they had changed there email, to forward the details onto them, as i did, they got back to me and said as they are now out of warranty as a goodwill gesture they would replace them for me, and was told that they have had problems with this wheel in the pat, and its no longer available, but in order to do this, i would have to drive over 600 miles, accommodation and a journey i am not fit for as i am recovering from cancer, i asked if i could send them back by courier, inconvenience to me as i will have to take vehicle off road to do so, but was told they would not accept them this way, and that they would hold the offer open for 6 months, or the other option was to buy another pair at cost and sell the faulty ones on eBay, was paid for on credit card, any one advice if i have any rights  thank you
    • HI   Further update email   Hi Pauline,   Thanks for your further email.   I can’t advise that you will not need to pay for the remainder of the booking until an alternative you are happy with is found, as this isn’t in line with the terms and conditions agreed to at the time of booking, or the package travel regulations. Customers who wish to keep the holiday in place would need to pay the remaining balance or it will be cancelled at the relevant charges, regardless of whether the hotel is affected.   If a booking is affected our priority will be to source an alternative hotel, to ensure customers can still go on holiday. If a suitable alternative can be provided, in line with the criteria set out in the package travel regulations, no refund will be due if the customer does not wish to travel on the holiday and make use the alternative hotel.   Kind regards,
    • Yes my signature and the correct address at the time, part of it anyway - the rest was hidden under the sticky note I'm guessing.   Ok so it is a copy of the CCA?
    • is that your sig in the two boxes and your correct address for time of takeout?   that would have been a sign and return form as it was a postal application for the card and that was what was sent back for you to sign and return again, keeping a copy yourself.   dx

      I was in Sainsbury’s today and did scan and shop.
      I arrived in after a busy day at work and immediately got distracted by the clothes.
       
      I put a few things in my trolley and then did a shop.
      I paid and was about to get into my car when the security guard stopped me and asked me to come back in.
       
      I did and they took me upstairs.
      I was mortified and said I forgot to scan the clothes and a conditioner, 5 items.
      I know its unacceptable but I was distracted and Initially hadn’t really planned to use scan and shop.
       
      No excuse.
      I offered to pay for the goods but the manager said it was too late.
      He looked at the CCTV and because I didn’t try to scan the items he was phoning the police.
       
      The cost of the items was about £40.
      I was crying at this point and told them I was a nurse, just coming from work and I could get struck off.
       
      They rang the police anyway and they came and issued me with a community resolution notice, which goes off my record in a year.
      I feel terrible. I have to declare this to my employer and NMC.
       
      They kept me in a room on my own with 4 staff and have banned me from all stores.
      The police said if I didn’t do the community order I would go to court and they would refer me to the PPS.
       
      I’m so stressed,
      can u appeal this or should I just accept it?

Cancel your Orange contract early due to increase in call and data charges

Before I go any further most of my post is taken from a thread started by ReVeD on Hotukdeals, I have only added my thoughts.

 

Orange will be from 14 Sep 2009 changing the cost of mobile internet browsing and some calls not included in your plan. For example. At the moment the minimum connection fee for calls made outside of your allocated minutes is 4.9p, however as of 14th Sep it will increase to 14.7p which is an increase of over 290%. You don’t need to have a Phd to figure out that is change is going to be to your financial determent if you exceed your inclusive minutes.

The long and the short of this is that Orange are changing the terms and conditions that apply to most of their non business customers, this will affect you even if you do not normally or have never gone over your allocated minutes. A contract is there to protect both parties, in this case as Orange are going to increase the cost of calling certain numbers, the minimum connection charge and daily charge for data allowance as a result you are well with in your rights to cancel the contract with out incurring an early cancellation charge. Remember it is Orange that are in breach of contract not you!

 

Such changes are covered under the clauses below which can be found on the Orange website.

 

4.3 You may also terminate your Contract if we vary its terms, resulting in an excessive increase in the Charges or changes that alter your rights under this Contract to your detriment. In such cases you would need to give us at least 14 days written notice prior to your Billing Date (and within one month of us telling you about the changes). However this option does not apply if:

 

4.3.1 we have increased the Charges by an amount equal to or less than the percentage increase in the All Items Index of Retail Prices published by the Central Statistical Office in the Monthly Digest of Statistics in any 12 month period;"

 

Orange will i expect make the return of your handset a condition of the closing of your account, however it clearly states under below clause that the handset does not form part of the contract.

 

"14 Devices

your Device is not a part of your Contract

 

14.1 Your Device and Accessories are acquired by you outside the terms of your Contract. "

 

If you don’t get through to somebody who will cancel your account the first time keep phoning. It took me a three attempts but I managed it ok in the end.

Your reasond for cancelling will have to be what affect YOU, and you prove to them that you are being unfairly penalised by the change. Only you can decide what part of it applies - it certainly isn't a 'get out of a contract free' card.

i managed to cancel with no problems, they said it didn't affect me, but i came out with that one day it might, so legally i can cancel...she put me on hold and gave in, cancelled the same day.

 

Its really easy to do and well worth it

Hey guys,

If i ring and cancel my contract early using this change of the call costs as the reason, will it affect my credit file as im cancelling a contract early?

Terminating the contract early will not in any way harm your credit record. :)

thanks for that! spent the last 12 months rebuilding my history and not missing nay payment and didnt wanna do this and then end up unable to get a new contract!

Does anybody know if there is anyway around still cancelling your contract?! My mates did theirs yesterday but now they are saying we can't! Any ideas or loophole we can use!??!

Orange have made a business decision not to introduce the proposed price changes, but will honour all existing cancellation requests. I expect they have seen their churn figures for the last 14 days and realised exactly how many people are leaving!

 

Remember, if Orange have agreed to action your request to terminate your account their decision not to introduce a change to their pricing policy will not affect you and your contract will be still be cancelled. If you have requested a PAC code this will still be issued.

Received a sms message via my internet dongle from orange, categorically stating that they are not increasing their charges or, changing the terms and conditions.

Hope the idiot who dreamt up the proposed changes, does not qualify for their bonus, it must have cost orange thousands of customers who have scattered to other companies.:D;)
