Morning everyone

 

since joining this site i have sat and read for hours :)

 

I have claimed back around £3k on PPI and credit card charges and have 12k worth of Bank Charges that are sitting waiting for the lords.

 

My question is regarding PPI that needs to go to court.

 

stupidly i increased my mortgage a few years ago with First Plus

 

They lent me the money on a secured loan of £65,000 and added a PPI premium of £15918.

 

gives me a loan of £80918

 

to make it worse i am on 11.4 interest.

 

I have written a standard letter bullet pionting all my concerns and have been told i signed the agreement so i was not missold.

 

Can anyone guide me to a solicter style or court standard claim PPI letter that would be taken more seriously. I was thinking that if i did take court action, what type of letter woul be required to shake them up a bit and get a better response.

 

Im sure that a letter that has been created by a solicter would make more of an impact.

If you come up with valid reasons for mis-selling then go back to the bank or whoever you have the loan with.

 

You should be able to reclaim PPI if you have a sound reason for a mis-selling claim. It is up to the bank or whoever to produce the evidence showing the PPI was not mis-sold. I would not just accept their statement that you signed the agreement so that's that.

 

Do more research, gather data and information and then claim.

I have no legal training and the advice I offer is a matter of support. Before you commit to any Legal action you are advised to contact a qualified legal practitioner.

Bank charge successes:

Halifax - Full settlement incl interest.

HSBC - Settlement, goodwill no admission of liability about 75% of claim.

RBS - Settlement, goodwill no admission of liability about 70% of claim.

2 ongoing claims for bank charges with HSBC with more to come. (Supreme Court ruling could have upset these claims) They did :mad:

PPI Successes

PPI 4 settlements on 9 loans. FOS involvement on 7 added on the 8 % Statutory interest another 30% to both.

2 claims settled in full with LV without FOS involvement.

2 claims settled in full with HSBC without FOS involvement

 

PPI Claims ongoing with:

Cap one Now with the FOS

Barclays. Paid up today 24/04/10 cheque received for over £4,500 and in the bank.

LTSB still have to decide on this as their SAR production was abysmal. Papers data mixed up documents missing etc

Keep at them. Do not give way and do not accept all they tell you, they will delay and stall for as long as they can to prevent repaying you your mis-sold PPI.
