Hiya folks, took a debt out with a payday loan company, lost job, couldn't afford to pay it, got a letter from a DCA - arranged monthly paymnets with them for £5 per month by standing order but the payments get getting returned to my bank so cancelled standing order, now had a letter from this baliaff and enforcement company threateneing all sorts, will I be able to arrange a repayment with them, still out of work so cant afford much more but to be honest its pretty much scared me. their threats and all so can anyone help? Cheers

Without a country court judgement (CCJ) Ballaifs will not be able to take enforcement action, so dont worry to much just yet.

 

Can someone confirm if PayDay type loans are covered under the CCA?

Yes, they are

If the company are intimidating you report them TS and the OFT straight away!

Can I still do that even though the "agreement" was "signed" online, meaning i just typed in my name etc.

It was only taken out about 7/8 months ago

There are not really intimidating me, just this first letter Ireceived from them has lots of options of what they might do, lots of legal stuff etc, pretty scary really.

I think its worse because I have heard baliffs get bad press and don't want them knocking on my dorr etc, didnt know I could make an agrrangemnet with them

can you scan the letter remove all personal info and post it up

it would be interesting to see what they are threating you with

if there is no CCJ then they are working as debt collectors and not bailiffs

are they threating you with bailiff action

Can't scan as don't have a scanner but it says this:

 

We write to confirm that one of our enforcement officers may attend your address within 7 days from the date of this letter, in relation to the outstanding amount for the purpose of serving a hand delivered notice and discuss the matter with you.

 

Further action may include a County Court Judgement being obtained against you,which will have an effect on your abaility to obtain credi. A warrent of Execution may also be obtained and your goods could be at risk from seizure in respect of the debt.

TAKE NOTE should further enforcement action be recommended by our office, additional costs will be incurred on this account for which you may be liable

 

No further notification will be sent, prior to the attendance of an Enforcement Officer (this is typed in red)

Enforcement Officer is another name for a bailiff and if there is no ccj then they shouldn't be sending letters like that

Amend to suit, send recorded keeping a copy with your postal receipt, do not sign print your name.

am i right in thinking that if they are collecting a debt collectors then

you can send them a letter telling them not to come to your house

Who ever heard of someone getting a job at the Jobcentre? The unemployed are sent there as penance for their sins, not to help them find work!
