Hey all

I`ve signed up to this forum as i`m after some advice/help.

A couple of months ago i sgined up for a Blackberry Storm Contract phone with vodafone, now i was told by my I.T teacher and my brother and mum that i would need some sort of I.D with me aswell as my bank card.Now i only had my bank card but the person who served me said that would be fine so i gave her my bank card and confirmed my address and so i got my phone and contract, without using any form of I.D whatsoever.


Anyways ever since day 1 i`ve have nothing but problems with it, so minor some major.

So i took it back to the store and they repaired it,and while i was there she told me that if i brought it back within like 28 days i could have swapped the handset to a different phone, but she NEVER told me that when i signed up,so i was passed the 28 days.


Anyways she sent it off for repair, got it repaired and have now had some more problems with it, and so she sent it away again today, and i said to her can`t you just changed the storm to a new one instead of repairing it, and she said no she can`t, all they can do is repair it,because of their policies.And that peed me off big time, as i don`t know why i should be paying for a phone that`s faulty, i didn`t sign up for that, i signed up for a phone that works, if i wanted one that was faulty i would have used ebay.

She also told me the 1st time i took it in, that if it goes faulty 3 or more times then i can change the phone to say like the bold, but today she said it has to be the same faults 3 times in a row within 28 days.


And so i`m just wandering if you guys can help me as i want to know what are my rights, can i cancel my contract on that as,they haven`t explained things cleary, they`ve given me a faulty know that they won`t exchange and they`re also signed me up without any form of I.D (i could have been my firend took his bank card and confirmed his address and that`s it he lumbered with the contract).


I also think that this is just one big con, sureley someone can do something about this.As it`s like a trap you sign that contact and you`re stuck paying £720(total for an 18months contract) for a phone that`s faulty).

Unfortunately nope, theres no room for termination. 9 outta 10 times they will never tell you about refund or exchange policies as they want to make you feel comfortable with what you have and basically only want to see you again when you are upgrading or getting an additional line. And basically your only paying for the SIM card, the minutes and texts. Not the phone!


Under the sale of Goods Act they are doing their part, basically when you go back to the retailer, you have 2 options either a like for like exchange or a repair. Once the repair option is taken it's kinda downhill from there, there is no limit to how many times I handset needs to be sent away, just most companies set one for their policies.


As for the ID thing, thats only company security. Its the same with most things, it has no legal standing unless you were the victim of ID fraud which isnt the case.


And as for how much your having to pay, such is the catch of a contract. Plus you'll find no mention of phone in your T&Cs except in their favour.

Stick to PAYG.

Yer i saw that mentioned on the vodafone forum that you`re paying for the sim, well i ain`t i`m paying for the phone.If i was paying for the sim i wouldn`t of bothered.

I`m just thinking of not paying it if it`s still faulty, or i might try a different conofone store to see what they say.

But it would be if i used my mates address and card.


P.S trust me i`ve learnt my lesson.1 don`t by from conafone and 2 stick to PAYG

your credit card would have been used to check your identity, plus you would have been credit checked. if you don't pay you will end up with a default which will potentially stop you from getting any other form of credit i.e. another contract mobile fone, car loan etc.

Can you confirm that this was a Vodafone store ?

The best advice is DON'T enter into a mobile phone contract. It ties you to a commitment you don't really need - and I can guarantee Vodafone anre not treating you any different than any other network would. The only 'loophole' I can see is if you are under 18, and whilst this would let you repudiate the contract, it meant that you agreed you were 18 or over, and results in a CIFAS (Fraud) flag on your credit file. Something you really don't need (or a Mobile Phone default for non payment).
