    • @Jaybee in CF Claimant commitments are agreed between yourself and the Job Centre Work Coach.  So you will be able to discuss the local jobs market, transport available and all of the local issues.   As it is a two way constructive relationship, you can research all of the relevant information, so when you have your claimant commitment agreed,  the information you have obtained can be considered.

    • Hello all,   I have recently moved into a new property. The bedroom window is facing a bunch of commercial crates which have trash on top of them. The trash is maybe two metres away from the window, making it impossible for the window to be open (I am also afraid of rats being there).   The other windows of the property are facing a communal, enclosed area, which is making it difficult for the property to be properly ventilated. I have already raised this issue with my estate agency and they are trying do to something about it (to be honest, if I leave everything to them, this issue won't be solved until my tenancy is finished, and that is more than one year away).   I am asking for advice, or how could I approach this issue.   I have spoken to my council and, since they do not deal in private property, there is nothing they can do, at least this is what they have told me.   The property with the trash is not owned by my landlord. It is an open space, with big crates, closed off by a fence. If I could, I would climb those crates and remove the trash myself but I cannot. I also cannot climb out the window to reach the trash, as the window is too small.   At times, I see a car in that property but I have never seen the driver. I left a note in the car's window explaining the issue and giving my number. This was around a week ago and nobody came back to me.   
    • Hi   First off ALL Tenants need to re report all the different repairs again via their repairs procedure. Yes its good to get a list of all properties repairs with photo/video evidence signed by all property tenants but you all need to fight this individually as well as a group.   Next you all need to look up your rights on Repair i.e. The Right to Repair Scheme and also their Complaints Procedure.   http://www.legislation.gov.uk/uksi/1994/133/made   https://england.shelter.org.uk/housing_advice/repairs/right_to_repair_for_council_tenants   All Tenants need to take control back with these repair and ask in writing titling any letter 'FORMAL COMPLAINT' and stating the repair and why it hasn't been carried out to date and an exact date when it will be completed.   You also require clarification whether these Repairs come under the Right to Repair Scheme and if so why we were never informed of this. (delete or amend)   You also require copies of the following:   Right to Repair Scheme Policy (Not the Leaflet Repair and Maintenance Policy (Not the Leaflet) Solar Panel Policy (Not the Leaflet) Complaints Policy (Not the Leaflet) Equality & Diversity Policy (Not the Leaflet) When you get the above policies you need to take your time reading them and just think to yourself 'DID THEY DO THAT' in relation to your issue and if not mark it this way you build a list of what they haven't done/followed as per there own Policies and use it against them.   They will have time limits to complete repairs within for Emergency, Urgent, Routine repairs and if they exceed that time limit and need to extend it remember it is with you the tenants agreement not them telling you and tough you can wait.   (bear in mind any repairs during COVID-19 the time limits are now different and most routine repairs are stopped)  
    • I was on UC in late March, and recently received some quite non-committal message that the commitments would be returning, but no indication when.     If I remember correctly the expectation was that we could find at least one job per day to which to apply, or some such nonsense.   Given that the government can only guess how many workplaces will be safe :  1) to commute to/from at the time of job application; 2) to work in at the time of job application;    3) to commute to/from at the date of starting a job ; 4) to work in at the date of starting a job,  5) to commute to/from at the date permanent WFH is dropped; 6) to work in at the date permanent WFH is dropped,    and given that we have lost 20% of our economy, I fail to see how they can both reasonably and immediately mandate any minimum figure of jobs we must apply for whilst this virus just killed over 135 people in the UK (stats released today).  That is only down from 155 last week, and about 175 a fortnight back.   At this rate it will be another 7 weeks MINIMUM before the mortality rate is zero - if it ever reaches zero before the inevitable second wave.

      I was in Sainsbury’s today and did scan and shop.
      I arrived in after a busy day at work and immediately got distracted by the clothes.
       
      I put a few things in my trolley and then did a shop.
      I paid and was about to get into my car when the security guard stopped me and asked me to come back in.
       
      I did and they took me upstairs.
      I was mortified and said I forgot to scan the clothes and a conditioner, 5 items.
      I know its unacceptable but I was distracted and Initially hadn’t really planned to use scan and shop.
       
      No excuse.
      I offered to pay for the goods but the manager said it was too late.
      He looked at the CCTV and because I didn’t try to scan the items he was phoning the police.
       
      The cost of the items was about £40.
      I was crying at this point and told them I was a nurse, just coming from work and I could get struck off.
       
      They rang the police anyway and they came and issued me with a community resolution notice, which goes off my record in a year.
      I feel terrible. I have to declare this to my employer and NMC.
       
      They kept me in a room on my own with 4 staff and have banned me from all stores.
      The police said if I didn’t do the community order I would go to court and they would refer me to the PPS.
       
      I’m so stressed,
      can u appeal this or should I just accept it?

Hi,

 

I have started the ball rolling with Rockwell and I also want to start things off with one of these two. Debt is very old, long story etc.

 

What has shocked me into action with these was Paragon. I received a letter recently and from what I can remember being a loan for a few thousand pounds seems to have turned into £16k :eek:

 

While they are not giving me any hassle I just want to check where I start

 

Do I start like I have with Rockwell and send them Letter N from the Library??

 

I have very little/no info on either of them so before I request anything I just want to check I am starting with the correct letter

send them the statute bared letter and report there sorry asses if they do not stop chasing the debt. Incidently they may try to say it is not sb because they have been sending you letters this is cr*p.

Who ever heard of someone getting a job at the Jobcentre? The unemployed are sent there as penance for their sins, not to help them find work!

Knowing Paragon, they probably have dug up an old calculation based on 'the rule of 75 (or it might be 76), it has been outlawed by the OFT and they should only use a three month interest 'penalty' at best.

 

I would also suspect they are clutching at straws and have discovered the debt is just short of being statute barred.

Hi. I have had my response back from Paragon.

 

It was a covering letter plus this single page which I have scanned in and removed mine & my x-wife's signature, my name and address plus the reference number .

 

Could you please offer some advice/help on where I stand on weather this is enforceable or not.. my last letter form them stated that I owed approx £16,000 form a £5000 loan

It might be worth going to see the CAB. I had a similar problem with Paragon but I had a CCJ with them which put me in a different situation. The CAB helped me write to them and they ended up writing of £10K extra interest. I only paid them the CCJ balance. The CAB may have had other people in your situation and will know what you need to say to them. Personally, I would tell them that they are not getting another penny out of me and to take me to court as I'm pretty confident they will not want that amount of interest to go in front of a judge but I understand if people do not want to take that risk.

Thanks for your reply. I had a letter from them today asking me to contact them (they dont have my phone number) as they would like to make an offer.

 

Should I write to them back asking what this offer is? also I wanted to ask them for all payments made to this account so I can get an idea of how much I have paid to them.

I would never call them. They are asking you to contact them so they can get your number and hound you. You're right to suggest writing back to them rather than calling. Personally I would write back and advise that you believe you have paid enough to more than cover the original loan (assuming you believe that you have over paid on this as they have not yet sent you any details of total payments) and to now get stuffed. As I said before, I'm pretty confident that they will not want this to go in front of a judge. They hound people until they make an offer and once they know that someone is fighting back they don't like it. I paid my judgement balance and thought that would be the end of it. They hounded me with phone calls and letters which I have no doubt they used to add another £20 or so to my balance each time. I wrote an official complaint to them regarding their lack of a legal basis to chase the further interest and lack of transparancy regarding the increasing balance (they never ever sent statements or advised me of the outstanding balance until I requested it). Basically, given the monthly amount I was paying was less than the interest being added each month, I would never have paid the debt. It might be worth going down the official complaint route pointing that out.

Just anothr thing. You mention that they have sent you a signed agreement (can't open it at work). I'm slightly suspicious as to why they want you to make an offer if this is a genuine agreement that could be used in court. They usually ask for offers if they believe they haven't got a leg to stand on. Don't want to suggest you do anything that could cause this to go to court and them win but as I said it's a bit suspicious. Was the original loan with Universal Credit by chance? If so, have you read the attached:

Hi, Thanks for your reply. Sorry for taking a while to come back on this. Yes this is a Universal Loan Agreement which is now in the hands of Paragon

 

I have just read that link to that other thread you posted. In some ways I am glad I am not the only one, but appalled that they are allowed to get away with this.

 

So just to recap on where I am at the moment

 

I sent them the letter asking for a copy of my loan agreement which they sent me which was a one sided photo copy and there is a link a few posts back. Other than a covering letter nothing else was provided. It does have my signature and my x-wife's signature too. Where do I stand with regards to this copy of the agreement. Does it look above board etc???

 

If thats the case and it looks all correct, is there anything I can do about the ridicules about of interest they are charging each month (£57pm)

 

They have asked me to ring they (yeah right) as they want to discuss a settlement figure.

 

I have written to them asking the following.

 

All payments make to this loan form day 1. This is so that I can work out approx what I have paid to them

 

Also that I only want to communicate via letter so that I can have a complete record of everything that goes on

 

Any help and advice on where I am now would be great

ok paragon probarbly wont have the info you need.

 

i would send UCL a sar. you need to include £10 po but this will get you all your transactions and copy of your default notice and termination notice and t and c's

Hi, Thanks for your quick reply. Back on post 10 I posted a pick of what they sent me which was a 1 page photocopy of what I and my x-wife signed which was a universal credit agreement. but that's all they have sent me. Nothing on the back and no other documentation. I am also concerned that the £5k loan is now £16K
