Hi All,

 

I took out finance through Advantage Finance in 2006 on a Toyota 4x4. I defaulted on the loan and the car has been off the road for the last two years after a botched clutch replacement set me back for a thousand pounds.

 

Advantage have now taken out a chargeing order on my property and I received a letter from their solicitors saying that unless I phoned them urgently they would instruct their client to proceed for a warrant for eviction.

 

I have made a proposal to pay them 100 pounds a month, the solicitors also included a financial statement form which in their own words, I was not legally obliged to fill in but if I didn't they wouldn't accept my repayment proposal and that Advantage would proceed with the warrant.

 

I was not overly happy with providing the information they were asking for, NI number, my childrens names and ages, all my asset info. like "Do you own a microwave? If so how old and how much did I pay for it? Do you own a TV? If so what size, type and age etc." ... you get the picture!

 

So I partially filled the form in and wrote back to the solicitors saying that I was not filling the form in entirely, and that they could proceed if they wanted but there are arrears on the mortgage and that once they have booted me and my family out I will file for bankruptcy straight away!

 

They have accepted albeit that I don't break the agreed amount per month.

 

HOWEVER!

 

I have noticed for a while now that on the original credit agreement for the vehicle the registration details are incorrect and the model of the vehicle is not what I have sat on my driveway.

 

Do I have anything in this to make the agreement invalid?

 

Have tried phoning local solicitors who are not interested, also CAB round here are a joke, only open 3 days a week and everytime I phone I get their answerphone!!!

hiya timskit

i would go onto DVLA and check vehicle reg & it will tell you exactly what vehicle it does belong 2.

also get in touch & complain to OFT

IMHO you may have a valid complaint, DONT worry because im sure the more experienced caggers will be along to help you with ur problem.
