    • Well, you've highlighted the problem yourself, whatever you decide will carry some risk.   However, I would think the risk of a default judgement & CCJ is to be avoided at all costs and the least worse thing would be to write them a two-line letter with their reference number and your new address.   As usual, any details you can give us on the forum sticky would be useful for the future

      I was in Sainsbury’s today and did scan and shop.
      I arrived in after a busy day at work and immediately got distracted by the clothes.
       
      I put a few things in my trolley and then did a shop.
      I paid and was about to get into my car when the security guard stopped me and asked me to come back in.
       
      I did and they took me upstairs.
      I was mortified and said I forgot to scan the clothes and a conditioner, 5 items.
      I know its unacceptable but I was distracted and Initially hadn’t really planned to use scan and shop.
       
      No excuse.
      I offered to pay for the goods but the manager said it was too late.
      He looked at the CCTV and because I didn’t try to scan the items he was phoning the police.
       
      The cost of the items was about £40.
      I was crying at this point and told them I was a nurse, just coming from work and I could get struck off.
       
      They rang the police anyway and they came and issued me with a community resolution notice, which goes off my record in a year.
      I feel terrible. I have to declare this to my employer and NMC.
       
      They kept me in a room on my own with 4 staff and have banned me from all stores.
      The police said if I didn’t do the community order I would go to court and they would refer me to the PPS.
       
      I’m so stressed,
      can u appeal this or should I just accept it?

Dear Forum,

 

Can you please give me some advice regarding my 3 mobile contract.

 

I have been with this network for 4years now and keep upgrading. I have just had my new contract for 18mths starting from the 13th July 2009 for £15 a month (Normal price is £21), this gives me 700 mins or texts plus 300min free 3 to 3 from my new start date.

 

Its now the 23rd and I still have not got my minutes added to the phone. I have called the customer service and they told me it starts from next month. This is what I would like help on.

 

1. Can I cancel my contract as they have not forfilled there side of it without paying the charge? Have they made the contract void by not forfilling there side of it?

 

2. My friend is on the 750min package for only £10 for 12mth contract. Is it possible for me to change my contract now (as above)?

Read The Contract Terms and Conditions, Check What The Return Policy Is, Usually Mobile Contracts Have a 14 Day Return Policy; However If What Was Stipulated By The Sales agent Hasn't Been Met From Their End, Then You Can Argue On That Basis.

 

If Your Outside Your 14days It Comes Down To The Fact How Much You really Want To Cancel It; Considering I canceled Mine With 3, 6 Months Into The Contract But Did Take a lot Of Phone Calls.

Dont Give up and You will Win. (Your Argument Must Be Reasonable and Logical)

The 14 days is new connections only, not upgrades. However if your new contract hasn't started yet, maybe you can contact them to cancel / take this other deal? (Just about all mobile companies have a retentions department... get your call put you thrugh to them)


If in doubt, contact a qualified insured legal professional (or my wife... she knows EVERYTHING)

Thank you all for replying.

I have sent them a fax of the contract and demanded that they either cancel my contract without charge or to activate my phone straight away and give me credit for the inconveinience.
