Hi Guys and Gals!!

 

Oh, I'm so confused!!

 

I recently obtained my credit report and noticed a CCJ on there dated 9/7/2007 that I was completely unaware of for £200 ish. I chased this up with the court quoting the case number and told it was Bryan Carter & Co for Capital One. But on my credit report it clearly shows that I paid the amount I defaulted in full and now has 'satisfied' next to it!

 

Have they just plucked a random sum out of mid air and forced a CCJ onto my credit report? How can they do that? What should I do?

I'm really worried because it has made my credit rating really poor! (although to be honest it wasn't amazing before, but I'm trying to rectify it!):confused::confused:

Have you got any correspondence from crapone stating that you had satisfied the default amount when you paid it off? Statements showing the amount paid off?

 

Did you pay off the full amount outstanding or did they come to an "arrangement" with you?

 

Did you ask the court to send you details of the claim for the CCJ, I think you need to see the particulars of the claim in the first instance.

Hello again,

 

Unfortunately no correspondance saying that I had paid it off, all old letters etc... I shredded them a few years ago assuming that would be the end of it. I paid the amount in two parts, my credit report says 'partial settlement' and gives a date. Then it says 'default satisfied' but with no date.

Should I write to bryan carter or capital one for more information if I use the letter saying 'I do not acknowledge this debt etc...'??

This what the court said "‘the claimant's claim is for the balance due under an agreement which is now all due and payable. the defendant agreed to pay monthly instalments under account numberXXXXXXXX but has failed to do so.and the claimant claims the sum of�XXXXX.the claimant also claims interest thereon pursuant to s.69 county court act 1984 limited to one year to the date hereof at the rate of8% per annum amounting to XXXXX

 

If I still owed them money why would my credit report say default satisfied? I'm sure I paid it all, but don't have any proof :(

Might be worth contacting crapone to see what they say in regards the account. Possibly worth a £10 SAR also.

PLEASE TAKE THE AGREEMENT NUMBER OUT OF THE CLAIM DETAILS ABOVE!!!
